- In the Name of God, Amen this twenty-third Day of January one thousand Seven Hundred And Eighty four I John McMahon of Augusta County And State of Virginia Being Very sick & Weak in Body But of A Perfect mind and memory thanks Be Given to God for it Therefore Calling to Mind the Mortality of My Body And knowing that it is appointed for All men once to Die – Do Make And ordain this my Last Will And Testament that is to Say principally and first of all I Give and recomend My Soul to the hands of God who gave it And for My Body I recomend it to the Earth to Be buryed in a Christian Like and Decent Manner at the discretion of My Executors Nothing doubting But At the General resurrection I Shall receive the Same again By the Mighty power of God, And as touching Such worldly Estate wherewith it hath pleased God to Bless me in this Life with, I Give Devise and dispose of the Same in the following manner and form Viz
- Imprimis I allow all my Just and Lawful Debts to Be Paid and Discharged of my whole Estate
- Item I give and Bequeath to my Dear and well beloved wife Deborah the one third part of the Land I now hold During her life Likewise the Bay Mare and Saddle Item to my Daughter Nancy I Give and Bequeath twelve Pounds annually to Be raised of the Land during her Life Item To my Son William I give and Bequeath the part of Land upon Which I now Live Containing three hundred and thirty acres to him and his Heirs forever
- Item to my Son Fifty Pounds Current Money of Virginia
- Item the Same I Bequeath to my Son Robert both to Be paid by My Son William when he comes to age

John McMahon by Robt McMahon Next Friend plt. agst. William Thompson Defendant. Neither party appearing this Suit is dismissed.
Two points argue for John's birth year to have been later than 1728; probably 1734:
First, in the courts of the time, a minor was unable to file suit on his own behalf (as were women). So the court required that a "Next Friend" represent the minor/woman in legal actions.
Robert McMahon, as John's Next Friend, filed a suit on John's behalf in May 1751. This means that John could not yet have been 21 in May of 1751. Had he been born in 1728 (as originally shown on this page), he would have been twenty-three in that year, and would have filed his case without a "Next Friend".
Therefore, John's birth year had to be later than 1728 but, probably before 1737.
The latter year is established by a court record of 17 Aug 1758 in which it is noted that Joshua Canterall, {is a}servant of John McMahon. In order to have an indentured man, John must, by 1758, have been at least 21. A birth year range of 1734-1737 seems reasonable.
Secondly, the Daughters (and Sons) of the American Revolution have documented John's birth year as 1734. While they are not infallible, all their records I have personally verified with primary resources have proven correct.
