Shaw, James - entered service 1780 in Greenbrier County, Virginia, in 9th Virginia Regiment; granted Pension age 56, Gallatin County, Kentucky in 1819; resided there in 1821, occupation farmer with had wife Elizabeth age 46, son James age 20, son Thomas age 12, son Joseph age 10 & daughter Rachel age 3; resided 1832 in Parke County, Indiana with children mentioned but not named; query letter in 1915 from great great granddaughter Mrs. Sidon Harris, Austin, Texas.     4th Judicial District of Kentucky SS
    On this 24th day of August before me the subscriber, Judge of the Circuit Court for the District aforesaid, personally appeared James Shaw, aged 56 years, resident in Gallatin County in the said district, who being by me first duly sworn according to the law doth on his oath make the following Declaration in order to obtain the provision made by the late act of Congress entitled "An act to provide for Certain Persons engaged in the Land and Naval Service of the United States during the Revolutionary War" That he the said James Shaw enlisted in Greenbrier County State of Virginia in the company commanded by Captain Benjamin Biggs of the 9th Virginia Regiment (formerly the 13th) commanded by Colonel Gipson for eighteen months and that he continued in the said Corps or in the Service of the United States until about the 1st of January 1782. When his term of service expired and he was discharged from the service at Wheeling Virginia by Captain Ben Biggs that he was in the battle between the American troops commanded by Lieutenant Harrison against the Indians near Fort McIntosh in Ohio – that he was in many skirmishes against the Indians during his term of enlistment that he was afterwards wounded whilst on a scout uponWhite Womans Creek against the Indians – being at that time a Volunteer in a Corps commanded by Captain Samuel Brady. And that he is in reduced circumstances and needs the Assistance of his Country for support that he has no other evidence now in his power of his said services than accompanying this Declaration.
    Sworn to before me this 24th day of August 1819: Given under my hand and seal the day and date as above.

    The Affidavit of Alexander McDowell1 taken by way of Confirming the above Declaration, said McDowell being 1st duly sworn saith, That he said McDowell new the before named James Shaw while a Soldier in the United States Service at Wheeling Virginia – that he was then in Captain Benjamin Pigs Company in the 9th Virginia Regiment that he does not know when he was discharged – And that he is poor and in reduced Circumstances and stands in need of the assistance of his Country.
    And further saith not.

    The Commonwealth of Kentucky Gallatin County Sct.: I Henry Davidge one of the Circuit Judges in and for the said Commonwealth and the Judge appointed to preside in the 4th Judicial district in the aforesaid Commonwealth do certify that James Shaw aged about 57 years personally appeared before me and made oath upon the holy evangelist of Almighty God that sometime in the month of March or April in the year of our Lord Christ 1780 he the said James in the State of Virginia and County of Green Brier [Greenbrier] – enlisted in the company commanded by Captain Benjamin Briggs of the 9th Virginia Regiment (formerly the 13th) which Regiment was commanded by Colonel Gipson that he enlisted for the Term of 18 months, that and continued in said Court in the Service of the United States until about the 1st of January in the year of our Lord 1782 when his Term of service expired and he was then regularly discharged by the said Captain Briggs at Wheeling in the State of Virginia. The affidavit is made in addition to his former declaration herein annexed. Sworn to before me this 22nd day of May in the year of our Lord 1820. Given under my hand as Judge aforesaid the day and year above written.

    State of Kentucky Sct. 4th Judicial District Gallatin Circuit Court to wit
    On this 31st day of August A.D. 1821 and in the 30th year of the Commonwealth
    personally appeared in Open court being a court of record for the said circuit with unlimited jurisdiction by the laws of the state James Shaw aged fifty-six years resident in the said County of Gallatin and circuit aforesaid who being first duly sworn according to law doth on his oath declare that he served in the revolutionary war as follows That he served as a private in the 9th Virginia Regiment in the company commanded by Captain Benjamin Biggs (agreeably to his original declaration dated on the __ day of __ which have been heretofore forwarded to the war Office and that he has received a pension Certificate (No. 17519) on which he has drawn his pension up to the 4th day of March 1820. And I do solemnly swear that I was a resident Citizen of the United States on the 18th day of March 1818 and that I have not since that time by gift, sale or in any manner whatever disposed of my property or any part thereof with intent thereby so to diminish it as to bring myself within the provision of an act of Congress entitled “an act to provide for certain persons engaged in the land and naval service of the United States in the revolutionary war” passed on the 18th day of March 1818, and that I have not nor has any person in trust for me any property, or securities, contracts or debts due to me nor have I any income other than what is contained in the schedule hereto annexed and by me subscribed to wit
    one mare 5 years old nearly blind value $15.00
    one horse Colt 3 years old value 30.00
    4 head of cattle value 30.00
    5 hogs value 15.00
    household and kitchen furniture value 10.00
    two sheep value 3,00

    The declarant is by occupation a Farmer, and lives upon rented land, from year-to-year and from his age and bodily infirmities not able to do much hard labor. He has a wife who lives with him her age is about 46 years by the name of Elizabeth who is a very sickly woman and not able to do much labor, he has 4 children that resides with him, one son named James aged 20 years very sickly and infirm and has not been able to do any labor for the last 18 months, one other son named Thomas aged 12 years, he is well and healthy, one other son named Joseph 10 years old he is well and healthy, the other one a daughter named Rachel 3 years old she is well and healthy.

    [f p. 17: On June 11, 1832, the veteran applied for the transfer of his pension benefit to the Indiana agency stating that he had moved to Parke County Indiana in consequence of the removal of his children.
    [Veteran was pensioned at the rate of $8 per month commencing August 24, 1819, for service as a private for 18 months in the Virginia Continental line.]
