Will of James McClung

In the name of God Amen, I James McClung of the County of GreenBrier and Commonwealth of Virginia. Being sick and weak in Body, but of perfect Mind and Memory, Thanks to the Almighty God for his Mercies and calling to Mind the mortality of the Body, & knowing that it is appointed for all Men once to die, do make and ordain this my last Will and Testament in manner & form following, First I recommend my Soul to almighty God who gave it and my Body to the Dust of the Earth to be buried in a christianlike and deacent Manner, not doubting but they will again Reunite at the General Resurrection by the mighty power of God, and as touching such worldly Goods and Estate wherewith It has pleased God to bless me with this Life, I give and dispose of in the following Manner and form, Vizt.
Item, after my just Debts and funeral Expenses are paid, I give and bequeath to my dearly beloved Wife Nancy, her thirds of the plantation I now live on together with the Mantion and other out Houses thereunto adjoining during her Widowhood also my Negro Girl by the name of Nann, to my Wife during Life, together with an Equal share of my personal Estate (not particularly enumerated) with my five Children that are unmarried.
I give and bequeath to my Son William, the Tract of Land I now live on to him and his Heirs forever with all the appertenances thereto belonging And touching my Negro Man Jarvis.
It is my Will and Desire that my Executor here after to be Named continue, him the said Jarvis at Labour for the Support of my Wife and five Children on said Farm Until they are otherwise provided for, unless he the said Jarvis should prove disobedient then on that Condition, It is my desire that he be sold, and his price to to the discharge of my just Debts If any should remain, & to the Education of those of my Children that are now unmarried, And the ballance of my personal Estate, I allow to be equally divided amongst my five Children, Viztl, Jane, William, Elizabeth, Nancy & Catherine, when they respectfully come of age or marry.
Item, it is my Will and Desire that if my Negroe Girl Nann (that I have desired to my Wife during Life) should, have any increase, it is my Will that the said Increase be equally divided between my five Children that are now unmarried, when they Respectfully Come of age or Marry, And if my son William should die before he has lawful issue, it is my Will and Desire that my Land that I have devised to him, __ all as every other Legacy herein Willed to him be equally divided between his four sisters above mentioned or to the survivor or survivors of them Respectfully, And if any of my said four daughters should die before they Marry or come of age it is my Will and desire that their share or shares be equally Divided amongst the survivor or survivors of them.
And lastly I do hereby Constitute & appoint my true and faithful friend, Samuel Brown Executor of this my last Will and Testaments, Revoking as disallowing of all former Will or Wills by me in my wise mind made, Ratifying and confirming this to be my last Will and Testament. In Witness whereof I have here unto set my Hand and Seal this tenth Day of August One Thousand Seven Hundred and Eighty Nine.

  • 20 July 1785 - Greenbrier Court Orders: On the petition of the same [Sampson and George Mathews] against James McClung and George Davidson for £3-3-0 due by note the same Judgement as the next above for the said £3-3-0 and the costs in this behalf expended. But this Judgement by discharged by the payment of £1-11-6 with Interest thereon from the 10th day of December 1774 til payment & the costs aforesaid.
