This is from Family and Ancestors of F. L. Martin and A. B. Ward: "Norfolk Co. Chancery suit $5162 (1810): Regards sale of land during 1802 from James Bartee of Norfolk for $520?, $300 which was paid by John Robins, rest is due. James Bartee died, leaving a will dated 8 Nov, 1802. The document mentions also Samuel Bartee, brother, Margaret Langley, sister, Isaac Bartee, Baily Guy and Elizabeth, his wife, and Susanna Langley and Robert Langley. Isaac Bartee and Robert Langley are not of full age, but in infancy. The suit appears to ask that the deed be binding until both are adults. James in his will of 1802 left control of his whole estate to his son Robert Bartee and any lawful heir of Robert, but they having no issue the estate would go to surviving children of his brother Samuel Bartee and the surviving children of his sister Margaret Langley...the said Robert Bartee died about the month of December 1809 in his minority intestate and without having issue...so that the estate [shall go to] the surviving children of said Samuel Bartee or James, Samuel and Isaac Bartee and Elizabet, now wife of Bailey Guy, and that the surviving children of Margaret Langley are Susanna and Robert Langley who it is alleged are entitled to the sum due from your orator (Robins) whenever the above mentioned deed shall be fully proven. (Robins stands willing to pay the sum.)" |
