McKinney, David - entered service 1780 in Augusta County, Virginia where he resided; died 5/7/1822 in Orange County, Indiana, or Washington County, Indiana; married 9/25/1785 to Margaret Wallace, widow applied for Pension age 85 in Washington County, Indiana, 1851; Pension Application rejected, insufficient proof of service & marriage, children mentioned but not named, soldier's cousin resided in Fulton County, Illinois, 1851 age 75. Service: Oct 15, 1777, Court Martial record, Augusta Co, Virginia David McKinney, Capt MOFFETT'S Company Virginia Militia, returned as a deliquent for not appearing at a private muster October 3, 1777 and was fined.

Oct 27, 1778, David McKinney of Capt TRIMBLE'S Company Virginia Militia returned as a deliquent for not appearing at a private muster Oct 6, 1778 and was to appear at next Court Martial.

April 13, 1779, David McKinney of Capt SIMPSON'S Company Virginia Militia returned deliquent for not appearing at private muster in Dec 1778 and was acquitted.

    State of Indiana County of Washington: SS
    On this 28th day of May 1851 personally appeared before the Subscriber a Justice of the peace in and for said County & State duly commissioned and qualified according to law and authorized by law to administer oaths Margaret McKinney a resident of said County aged eighty-five years who being first duly sworn according to law doth on her oath make the following declaration in order to obtain the benefit of the provision made by the act of Congress passed July 7th 1838 entitled "An act granting half pay and pensions to certain widows," and the Amendatory acts thereof passed by Congress.
    That she is the widow of David McKinney who was a soldier (private) in Captain __ Company commanded by Colonel __. That she further declares that she was married to the said David McKinney on the 25th day of September in the year 1785. That her husband the aforesaid David McKinney died on the 7th day of May in the year 1822. That she was not married to him prior to his leaving the service but the marriage took place previous to the first day of January 1794 – viz. at the time above stated. That declarant has no positive recollection of the services of her deceased husband David McKinney during the Revolutionary War as spoken of by him in his lifetime, but thinks he served the space of 3 or 4 years viz., The space of one year or less the first tour thence three years or to the end of the said war. She thinks he the said David McKinney served part of said time in South Carolina and that he was wounded in the battle at a place called "the Cowpens" or "Cow-plains".
    That she was MargaretWallace before her said marriage to the said David McKinney which took place in the County of Augusta State of Virginia on the 25th day of September 1785 and was solemnized by Archibald Scott a minister of the Gospel and her said husband David McKinney died in the County of Orange in the State of Indiana the day and year above stated.
    She thinks the said David McKinney served in said war in the year 1780 and after said anno domini but as to the period cannot positively say even if she ever knew when he entered and when he left said Military Service but declarant's confidence in the truth of her deceased husband's assertions recollected by her warrants her in the full belief that he the aforesaid David McKinney did serve a considerable space of time as a soldier in the war of the Revolution and that he resided in the State of Virginia when he entered and at the time he was discharged from said service & she thinks he resided in Augusta County in said State and that she (claimant) has no documentary evidence in support of her claim that from advanced age and bodily infirmity she is unable to appear before a Court to make this declaration . She further declares that she is still the widow of said David McKinney and that he may have served at one time under Captain McKittrick & does not recollect the names of any of the field officers under whom he served.

    [p 2: On June 16, 1851 in Fulton County Illinois, James McPheeters, 75, gave testimony that he was a cousin of David McKinney; knew him for the space of 40 years before his death; that his death occurred in Washington County Indiana; that his cousin intermarried with Margaret Wallace which marriage took place in the deponent's father's house in Augusta County Virginia; that he has reason to believe that his cousin served under Captain McKittrick.]

    fined. Oct. 27, 1778, David McKinney of Capt. Trimble’s CO.,
    Vir. Militia, returned as a delinquent for not appearing at a pri.
    muster Oct. 6, 1778, and was to appear at next Court Martial.
    April 13, 1779, it was shown he had removed to Rockbridge Co.
    Oct. 16, 1779, David McKinney of Capt. Simpson’s CO., Vir.
    Militia, returned delinquent for not appearing at pri. muster in
    Dec., 1778, and was acquitted.
