I Daniel Lewis of the County of Franklin in the State of Mi ssouri do make and publish this my last will and testamen t in manner and form following that is to say First it is m y will that all my my (sic) just debts be fully paid. Secon d, I give devise and bequeath to my beloved wife Abigail Le wis in lieu of her dower the plantation on which we now res ide situated in Franklin County it being the South West qua rter of the South East quarter of Section Five in Townshi p Forty one of Range Two East containing forty acres durin g her Natural life and Two Bay Mares, Two Cows and calves T en head of choise sheep Twenty five head of the choise Hog s one yoke of oxen one wagon one side saddle all the Househ old and kitchen furniture except Five beds, and furniture a ll the Farming utensils all grain and provisions on hand a t my Decd During her natural life as aforesaid and that a t the Death of my said wife all the property here by devise d or bequeathed to her as aforesaid or so much therof as ma y then remain unexpended, of the waistable property to my F ive children James B. Lewis Rebecka Short William P. Lewi s Jane Lewis Joshua W. Lewis and the real estate or land t o my son Joshua W. Lewis individually for his heirs or assi gns forever. Third, I give and devise to my eldest son Jame s B. Lewis Forty acres of land it being the South East four th of South East quarter of Section Five in Township No. Fo rty one of Range No. Two east, all so one Bed and furnitur e to him and his heirs forever. Fourth, I give and devise t o my Daughter Rebecka Short One hundred Dollars one Bed an d furniture to her & heirs forever. Fifth I give and devis e to my son William P. Lewis one Bed and furniture also For ty acres of land it being the North East quarter of the Nor th East quarter of Section No. Eight in Township forty on e of Range No. Two East to him and his heirs and assigns fo rever. Sixth, I give and devise to my Daughter Jane Lewis o ne Bed and Furniture also one hundred Dollars in money to h er and her heirs forever. Seventh, I give and devise to m y son Joshua W. Lewis Forty acres of Land it being the Nort h half of the West half of the North East quarter of Sectio n No. Eight in Township No. Forty one of Range No. Two Eas t One Bay Colt one year old also one Bed and Furniture als o my rifle gun to him his heirs and assigns forever. Eighth , It is my wish and desire that my Executors shall sell al l my property or the remainder on a Twelve Months Credit th at is not there in devised or designated and the proceeds d evide equally bet[w]een Abigail Lewis my Wife and five chil dren before named. And Lastly I here by constitute and appo int my son James B. Lewis and William P. Lewis my son to b e the executors to this my last will and testament revokein g and annuling all former wills by me made and ratifying an d confirming this and no other to be my last will and Testa ment. Bishop Deputy Old Hamilton Family Cemetery, Franklin County, Missouri `Ha milton Family Cemetery, located on bluff overlooking Mill H ill Rd. bridge on Oak Grove Church Rd., Lonedell, Frankli n Co., MO. Hamilton, C. 10/17/1837 - 4/12/1885 Ennis, W.H . (no dates) Co. E, 26th INF. Lewis, Francis Hanna d. 11/10 /1849 (4M) dau. of Thomas & Elizabeth Half of the cemeter y is located on the property of Wm. P. Foster and half on t he Walter Decker property. Although there are only 3 graves tones, there are at least 13 more graves marked with fields tones.` According to Helen Whitworth, C. Hamilton was Chesl ey Hamilton. She counted 20 fieldstones on her visit. I als o visited the cemetery in 1980 and found only fieldstones . The cemetery is described in the 1958 Lewis family book a s the `old Hamilton cemetery` located a quarter mile from t he mouth of the Little Meramec River. It states that Danie l Lewis and wife and their son `Doc` Joshua Lewis are burie d there. Daniel Lewis was born c. 1795 in NC and died 184 4 in Franklin Co., MO. His wife was Abigail (nee Brown), b. c. 1801 in TN and died between 1850-60 in Franklin Co., MO . Their son Joshua W. Lewis was b.c. 1825 in AL or TN and p robably died soon after Jul 1870 in Franklin Co., MO, whe n his will was dated. His wife was Diana Margaret (nee Lewi s), who was possibly the daughter of William W. and Margare t (Bay) Lewis. I don`t know what connection, if any, ther e was between Thomas & Elizabeth Lewis and Daniel & Abigai l Lewis.
(Research):Daniel LEWIS b. about 1790-1800 probably in NC1, 9 or perhaps AL2; married Abigail BROWN3 Daniel died betwee n 13 Mar. 1843 and 21 Nov. 1844 in Franklin Co., MO7 Both h e and his wife were buried in Hamilton Cemetery.15 The ance stry of Daniel LEWIS is unknown. He is NOT the same as Daniel Pennington LEWIS who was bor n 20 Jan. 1802, son of James LEWIS and Ann Elizabeth STEWAR T, with whom some researchers have confused him.
