Discrepancy in parentage of Catherine Torbet

There are conflicing records in Augusta County, VA regarding the parentage of Catherine Torbet. In the record of her marriage license with Anthony Black, her father is clearly identifed as Robert Torbet:

  • Vol. 2 - Marriage License in Augusta County - Augusta County, 1798--November 6, Anthony Black and John Torbet, surety. Anthony Black and Catherine Torbet, of age, daughter of Robert Torbet. "This is to certify that we are agreed to this match. Given under my hand. Hugh Torbet."

But in the following Chalkey's reference, she is identified as the "daughter" of Hugh Torbet:

  • Vol. 2 - Torbett vs. Torbett--O. S. 29; N. S. 10--Augusta. Hugh and Robert Torbett were brothers. Samuel Torbett was son of Hugh. Anthony Black married Hugh Torbett's daughter. (Note: perhaps the term "daughter" was being used loosely, since Robert had already died and Catherine was thought to have been raised by her Uncle Hugh?)


It is clear that Hugh Torbet was the person that signed to attest that Catherine was of age in the marriage license, so it is thought since Hugh's brother, Robert had already died prior to Catherine's marriage and was acting as her father "by proxy", after Robert's death. Catherine's inclusion in court cases in Augusta County, including her as an heir of Hugh Torbet is confusing in trying to ascertain whether she was Robert or Hugh's daughter, although they don't specifically state that she was a daughter of Hugh, just and "heir-in-law", which could conceivably have included her, since she was most likely Hugh's niece and guardian after Robert's death. More research is necessary, although she has tentatively been placed as a daughter of Robert until evidence is shown to the contrary.
