LAST WILL AND TESTAMENT OF JOHN DUGGER SR. COPIED FROM THE WILL ON FILE IN THE RECORDS OF THE COUNTY COURT CLERK'S OFFICE IN THE COURT HOUSE AT MOUNTAIN CITY, JOHNSON COUNTY TENNESSEE.

1. I, John Dugger Sr., desire that here after my death, bury me in a plain and decent form. 2. I give my soul to God who gave it to me. 3. I desire that my sons, that are alive, shall have one equal share of my part in the forge and sawmill. I desire that my eldest son, John Dugger Jr. shall have one hundred five acres of land, including the place where Solomon Younce now lives and to join Esquire Morgan Swifts, which is that much more than the rest of his brothers get of the forge lands. The rest of his brothers get minerals, except he shall have equal share of the rest of the iron works land. 4. I desire that My daughter, Mildred Anderson, shall have an equal share in my part of the sawmill with her brothers. 5. I desire that my son, Samuel Dugger, shall have one hundred acres where he now lives and an equal share in the forge lands and sawmill, mines and minerals excepted. 6. I desire that my son William B. Dugger have the land he now lives on, it is thought to be one hundred acres, more or less, and an equal share in the forge land and sawmill, mines and minerals excepted. 7. I desire that my son, Joseph Dugger have the land he now lives on. The minerals of iron ore to be divided with his brothers, if they want to work in the forge and sawmill, I desire them to sell to some of their brothers. I desire that my son, Hiram Dugger, shall have a piece of land on the Chestnut Land on the Chestnut Ridge, thought to be one hundred twenty acres more or less, adjoining the flat of Dugger Branch, and an equal share in my forge and sawmill and forge land, with his brothers. John Dugger has two shares in the forge land, the mines and minerals excepted for me and my heirs. 8. I desire that my son, Benjamin C. Dugger, shall have one hundred acres of land at the foot of Stone Mountain and Bakers Gap Road and joins Thomas Ward's land, mines and minerals excepted. I desire that my son, Benjamin C. Dugger, shall have an equal share with his brothers in my forge and sawmill and forge land. Only John Dugger Jr. who has two shares of mines and minerals except for me and my heirs. 9. I desire that my son Joseph Dugger, shall have an equal share with his brothers, in my part of the forge and sawmill and an equal part in my shares of the forge land with the rest of his brothers. Only his brother John Dugger Jr., who has two shares in the forge land, mines and minerals excepted for my use and the use of my heirs. 10. I desire that Solomon Quince Dugger, my youngest son, have the land I sold him for his part of my land. I also desire that he shall have equal share in my forge and sawmill and forge lands, with the rest of his brothers, only his brother, John Dugger Jr., who has two shares in the forge lands, mines and minerals excepted for me and my heirs. 11. I desire that my son, Peter E. Dugger, have the land I sold him and he paid me for same. I also desire that he, Peter E. Dugger, shall have an equal share with the rest of his brothers in my part of the forge and forge lands and sawmill and his brother, John Dugger Jr., has two shares in the forge lands, mines and minerals excepted for me and my heirs. 12. I, John Dugger Sr., desire that my daughter, Charlott Cable, wife of Claiborn Cable, shall have one hundred acres of land known by the name of Flat Springs Land, lying in the Watauga County, North Carolina, it being a two hundred acre tract of land, being granted to me by the State of North Carolina. 13. I desire that my daughter, Emily Bunton, wife of Elijah Bunton, have the other half of said Flat Springs Land to be equally divided by them and a line made through said land with courses and distances and they shall have a deed for it, mines and minerals excepted for my use. 14. I desire that my daughter, Mary Whitehead, wife of Thomas Whitehead, have two hundred acres of land in a thousand acre tract of land that joins a thousand acre tract of land on the east end. Joins the land that Esquire Daugherty use to own on Dry Bend, joins the foot of Iron Mountain and Bakers Gap Road, mines and minerals excepted for my use. 15. I desire that my grandson, George W. Dugger, and Elizabeth Angeline Dugger, and Nancy Gaddy, and Martha Green, have one hundred acres of land, each in the thousand acre tract that joins the foot of Stone Mountain, in part along the Baker Gap Road, mines and minerals excepted for my use. 16. I desire that my grandson, Hiram Dugger, have one bed and bedding. 17. I desire that my son-in-law, Harrison Gregg, shall if he finds a good vein of lead on any of my lands, only the fifty acres of mine and William Dugger, shall have fifty dollars worth of minerals or the value of it when melted. 18. I desire that My daughter, Mildred Anderson, and John Anderson, have the place where I now live and have sold it to Mildred and John Anderson, her husband, for four hundred dollars and they are to take good care of me and my property feed and clothe me all the rest of my lifetime, and on the above condition the house and one hundred acres of land shall be theirs, otherwise, they must pay me one thousand dollars or give me my house and land and make me a title to it and all will be right. 19. I desire that Colonel Kerk have privileges to work my lead mine, if he cares to do it soon and if he finds metal, let him melt it and give what is right of the metal. 20. I desire that Solomon Quince Dugger and Peter Engle Dugger and Joseph Dugger my sons shall make settlement with their brothers and sisters and all others that have a lawful claim. 21. I desire that my brother, William Dugger, help my heirs in their settlement and that Peter and Joseph and Solomon Quince Dugger pay him for his troubles out of my estate. 22. I desire that my son. Solomon Quince Dugger, have the power of attorney or a general letter of an attorney to do my business, as I am not able to see to it myself. I hope that you will see to it faithfully and honestly and take the oath to do it without fear of favor and honesty. This the Second day of June, 1869. 23. I desire that my children all meet together and settle with each other in love and peace. I desire that my son, Solomon Quince Dugger to write to them as soon after my death as he can and set a time for them to meet here. 24. I desire that John Anderson and Mildred Anderson, if I die before I sell what little stock and property I have, to let it be sold or Divided. You may divide or sell for money to help in paying my debts, etc. 25. I hereby revoke all former wills made in witness whereof I have set my hand and seal this the Eighth day of June, 1869.
