Transcript

State of North Carolina Iredell County: Personally appeared before us the undersigned Justices of the County aforesaid James Houston and being sworn as the law directs deposeth and saith that he is the same James Houston that was examined before Doctors Harris & Henderson acting under a Commission from his Honor Judge Potter directed to Doctor Joseph McKnit Alexander and was put on the Pension list of the United States at the rate of $180 a year.

Sworn to and signed before us this 4th of September 1817

State of North Carolina Iredell County

On this 11th day of November 1840 personally appeared before me, Justice of the peace of the said State & County Asenath Houston a resident of the same aged eighty-five years, who being duly sworn according to law doth on her oath make the following declaration, in order to obtain the benefit of the provision made by act of Congress passed July 7th 1838, entitled "an act granting half pay & pensions to certain widows:"

That she is the widow of James Houston who served in the militia of North Carolina & to the best of her knowledge & belief as follows: he served as Captain of a company of militia volunteers under Colonel William Polk who commanded the Regiment which went out with a Regiment of Regulars under Colonel Alexander Martin of North Carolina line to South Carolina towards Ninety Six in what was known here as the Snow a Campaign in winter of 1777 or '78 as she believes & was gone something like three months – that he served a tour in Charleston in the North Carolina militia as volunteer for six months which expired on the day before the surrender of Charleston. That he served as Captain of a volunteer company under Captain Francis Locke during which was fought the battle of Ramsour's Mills in then Tryon, now Lincoln County North Carolina on 21st June 1780 with the Tories in which he was severely wounded. Term of service not recollected – he served in another expedition to Guilford County North Carolina the time nor how long not recollected – he was a pensioner of the State of North Carolina war of the United States unknown which & all the papers & records of said Houston were transmitted to the proper office of one or other.

She further declares that she was married to the said James Houston on September 29, 1774 that her husband the said James Houston died August 2nd, 1819. That she was married previous to 1794.

Affidavit of Ephraim Davidson – who being duly sworn maketh oath that he was well acquainted with James Houston aforesaid – that he was a Captain as he understood at Ramsour's mill – that he saw him there after the battle & was lying wounded – that he saw him in camp under General Sumner in Rowan County in 1781 does not know how long or whether as private or officer, but acted in commissary Department – that Asenath Houston is the widow of said James Houston& has not been married to anyone else.

Affidavit of Adam Torrence1 who being duly sworn maketh oath that he knew James Houston aforesaid that the said James Houston as he was informed & believes was out in the Smilly Campaign & also at Charleston as stated above – that he saw him at "Ramsour's Mill" also –& that he was Captain of the Company there to which I belonged – how long he served not now known – that Asenath Houston is the widow of said James Houston.

On November 13, 1841 the widow made an additional application in Iredell County North Carolina; in this document she states that her name prior to her marriage was Asenath Brevard; that they were married in Rowan County North Carolina on September 29, 1774 by a Minister of the Gospel whose name she does not recollect; that her husband lived in her same neighborhood in Rowan County at the time they were married until the time of his death except for 2 years they lived in Mecklenburg County North Carolina; that her husband died in Iredell County August 2nd, 1819; that she remains his widow; as to her recollection and understanding of her husband's services she states as follows: "He served as Captain of a company of volunteer militia under Colonel William Polk who commanded the Regiment which went out with a Regiment of Regulars under Colonel Alexander Martin of the North Carolina line to South Carolina towards Ninety Six in what was known here as the snowy-campaign in the winter of 1777 or 1778 as she believes & was in service something like 3 months. That he served a tour to Charleston South Carolina in the North Carolina militia as a volunteer for 6 months which expired on the day before the surrender of Charleston; That he served as a Captain of a volunteer Company under Colonel Francis Locke during which service the battle of Ramsour's Mill in then Tryon, now Lincoln County North Carolina, was fought on the 21st day of June A.D. 1780 with the Tories, in which he was severely wounded in the left thigh, the ball passed claim through just above the knee & he was called home in a wagon; time of service not recollected; He served in another expedition to Guilford County North Carolina the time he served, nor how long, she does not recollect: These are all the times of service remembered by applicant, but begs leave to state that said James Houston her deceased husband was a pensioner (as she is informed of the United States & supposes for disability from his words) & begs leave to refer to the papers & evidence filed by him as to his services in whatever office they may be; she further declares the ages of her self & husband the said James Houston to be these the said James Houston was born June 22nd, 1747 and died August 2nd A.D. 18 to 19 & she the said Asenath Houston was born December 26 A.D. 1755 & that they were married September 29th A.D. 1774, she further states that the above dates in reference to their births & marriage & death of said James Houston her deceased husband all made or taken from the family record."]

A finding by the court in Catawba County North Carolina dated April 12, 1853 that Asenath Houston, a pensioner at the rate of $120 per annum and the widow of the late Captain James Houston died June 13 A.D. 1843 leaving surviving her the following children only: William, Sarah M. McRee, who was Sarah M. Houston, Edward R., Richard F, George S, Mary C Torance, who was Mary C Houston, and J B Houston, her executor.]


May the 15th 1780

By Virtue of a Power invested in may by a Resolve of the General Assembly in hiring me to appoint a Proper Person or persons in each County in the District of Salisbury to Purchase Provisions Spirits &c For the use of the Militia of said District, to go to the aid of South Carolina, under the command of Major General Caswell. I by these appoint Mr. James Houston to that Department, to act as above mentioned, he is also empowered to impress wagons, Paying

[Veteran's widow was pensioned at the rate of $324.66 per annum commencing March 4th, 1831 & ending June 13 1843 for her husband's service of 15 months as a Captain and one month and 7 days as forage master in the North Carolina militia.]
