Will Transcript
- In the Name of God Amen this thirtyeth day of January one thousand seven hundred and seventy and five, I William Evans, Farmer of Loudoun County and Colony of Virginia being much indisposed and weak in body but of perfect mind and memory thanks be given to God, therefore calling to mind the mortality of my body knowing that it is appointed for all men once to die do make and ordain this my last Will and testament that is to say principally and first of all I give and recommend my soul to God that gave it and my body I recommend to the earth from whence it cane to be buried in decent & Christian Burial at the discretion of my executors and as touching my worldly estate wherewith it hath pleased God to bless me in this life I do give and devise and dispose of the same in the following manner and form Viz:
- I give and bequeath to my lawfull and loving wife Mary Evans all my moveable estate to be disposed of by her as she shall think proper and likewise all my rents and interests of money I will and Bequeath to my loveing wife for her use and support whilst she remains my widow & after she marrys then to be applied to the use of my son John Evans & likewise I Will and bequeath to my loveing wife one hundred pounds lawful money of Virginia to be paye by my Executors after all my just debts are discharged I say to be paid to her out of my debts due to me the which she is to possess enjoy during her natural life & at her death then to return and to be equally divided between my son John Evans and her son Thomas Hanne. It is my Will and desire likewise that my loving Wife shall peaceably enjoy and possess the house and preserve during her widowhood reserved in John Hanna Case.
- Item I will and bequeath unto my wife's son Thomas Hannah the land left to her by her brother Nathan Davis's last Will and Testament.
- I likewise give and bequeath unto sd. Thomas Hanna one hundred Acres of land of the followlick tract to be taken off joining to John Davis's line this land to be made over to said Thomas Hannah when he arrives to the age of 21 years and likewise I will and bequeath to said Thomas Hannah thirty pounds lawfull money of Virginia to be paid by my son John Evans when he the said John shall arrive to the age of 21 years and in case sd. Thomas Hanna shall die before he arrives to age to enjoy those legacies that the said Legacies and bequeathments shall then return to and be applyed to the use of my son John Evans.
- Item i will and bequeath unto my lawfully begotten son John Evans all and singular my lands messuages and tenements remaining after the aforesaid bequeathments by him to be freely possesed and enjoyed excepting a sufficient sum to taken out of my yearly entrusts & incomes for the schooling of my son John and my wife's son Thomas.
- I likewise request and desire of my executors as my last Will and testament to bind or cause to be bound my son John to such trade as he shall choose at the age of 16 years & I do hereby nominate Constutute make and ordain my loving and trusty friends John Davis and Nicholas Marper my sole Executors of this my last Will and testament & I do hereby revoke & disannul all and every other former testaments, Wills, legacies & bequeathments & executors by me in any ways before named Willed and bequeathed Ratifying and confirming this and no other to be my last Will and testament.

- On the motion of William Hammer Administrator of Thomas Evans deceased a dedimus is awarded him to examine and to hold the depositions of John Steel a resident of Kentuckey and John Hanna a resident of Tensee [Tennessee] which persons are subscribing witnesses to the last Will and Testament of William Evans deceased and the said depositoins are to be taken for the purpose of admitting the said Will to record and the said Commission is to be directed to such persons as are authorized to execute the same

- Deposition of John Steel who deposeth and saith that he John Steel saw William Evans the testator of the annexed Will bearing date January the thirteenth in the year one thousand seven hundred and seventy five signe seal publish and declare the said Will to be his last and the said John Steel further sayeth that he believed the said Evans to be in his proper senses at the time of the execution thereof.

- Deposition of John Hannah deposeth and says after being first duly sworn that he John Hannah saw William Evans seal and sign a will bearing date the thirteenth day of January in the year of our Lord one thousand seven hundred and seventy five as his last Will and testament and the said John Hannah further says and believes that the said William Evans was in his proper senses and had the full use and exercises of his reason at the time of sining [signing] publishing and proclaiming the same
