[This comes from the "News" section of the West/Fike Family Concerning this part only (at this time): "a. His birth date - Even though some researchers believe that Thomas West, Jr. was born about 1735, and that his elder brother Richard West was born about 1733, I see no concrete evidence to support this hypothesis. (At least in my research, I have found no evidence to support this.) In order to approach the parentage issue from a conservative standpoint, it is important that I broach this subject with everyone.) The 1755 Tax List of Granville County, North Carolina, confirms that Richard West was definitely born sometime between 1738 and 1739. Most likely, he and Malachi Fike are the same age.**Note - Richard West and his father Thomas West, Sr.'s possible connections to Caroline County, Virginia, are only theoretical." - Ben West

According to my source - "North Carolina Research Genealogy and Local History" edited by Helen F. M. Leary and Maurice R. Stirwalt, published by The North Carolina Genealogical Society, Raleigh, NC 1980, Pp. 633 - Part II: County Records, Article 13 by Raymond A. Winslow, Jr. "Tax and Fiscal Records", pp. 214 & 215, a law enacted by the NC General Assembly in 1749 stated, "...all and every White Person, Male, of the Age of Sixteen Years, and upwards... shall be deemed taxables..." [Note: that I left out the part about Negroes, Mulattoes, etc. and others of the age of 12 years & upwards were taxables - JGW] "Some provisions of the tax laws were so generally ignored that the Assembly complained in 1760 that a 'full and compleat List has never yet been obtained...' " From these statements in Mz. Leary's book [I have met her in person here in Evansville - she is a great genealogical speaker!], to be listed in the 1755 Tax list one must be at least 16 years old. Thus, with the entry in that 1755 Tax list for Granville Co., NC of Thomas West and son, Richard West - Richard must be 16 years old or older (how much older is not known). Simple math of 16 years from 1755 gives us 1739. Therefore, we can say with confidence that Richard West the son of Thomas West was born in 1739 or earlier. This is what Dr. C. Nash Herndon told me many years ago, and when I asked him how he arrived at that date of "1739 or earlier" he explained the minimum age of 16, but that we do not know if he was also listed in any earlier Tax list as they are not available. Family tradition says that Thomas, Jr. was the oldest. I will have to go thoroughly through my files to see why my records show "about 1735" for the birth of Thomas, Jr. But, by 1755, Thomas, Jr. is not listed with his father like Richard was listed. As one West researcher, I use "abt. 1735" for Thomas, Jr. and "1739 or earlier" for Richard. I do not see that the 1755 Tax List "confirms that Richard West was definitely born sometime between 1738 and 1739." It only confirms that he was born no later than 1739. If we had prior years' tax lists we might see Richard listed for several years before. We just do not know when he turned 16, we just know that he was at least 16 in 1755. Think about this the father, Thomas, Sr., had to be at least 16 years of age, as well - and we know that he was born quite a while before 1739! <grin> Ben, I have never seen any records of this line that indicated that Richard was born in 1733 or that he was the eldest. I must confess that I know that the "1718 or earlier" birth date for Thomas West, Sr. comes from an arbitrary date I selected that was exactly 200 years before my father's birth in 1918. We originally only had a birth date for Ignatius (1750) and that Richard was at least born in "1739 or earlier," so if Thomas, Sr. was at least 21 when one of his first children was born, he had to be born "1718 or earlier!" Ben, I was looking over some of the photos (after posting my old copy of the West Coat of Arms) and thought I would take a closer look at the 1760 Granville County, NC Tithables. As best as I can read there are three Thos. West listings and one for Richard West. One entry is: "Thos. West [first line] & son Thos West Jr. }2" The other Thos. West is listed alone with one tithable as is Richard's entry. Richard by 1760 is at least 21 (born 1739 or earlier). And, this means that Thos. West, Jr. is at least 16 years of age in 1760 and, thusly, born 1744 or earlier! But, who is the other Thos. or is it a double entry? This is probably where the 1744 date came from. After going through some of my files I find that Dr. C. Nash Herndon also has Richard as the oldest child and no estimated date of birth for Thomas, Jr. Dr. Herndon just states that Thomas, Jr. is believed to have been born between Richard & Ignatius! Now, I will have to dig further to see where *I* got "about 1735" for Thomas, Jr's birth. We can use with confidence the "1744 or earlier" birth date for Thomas West, Jr. [source: 1760 Granville County, NC Tithables] J


Will of Thomas West, Jr. (Born 1744 or earlier and Died about 1821)

I Thomas West of the county of Chatham, farmer, do hereby make my last will and testament, revolking all others heretofore made.

In the first place I appoint Jesse West my second son and Joseph Meacham, my son in law from the reliance I have in their integrity my executors to execute and carry into effect this my will.

Secondly I leave and bequeath to my said executors Jesse and Joseph all my Estate real and personal forever, liable to the trust now declared in this my will, it being my principal object and desire to provide for my wife, should she outlive me, during her life comfortably and that at her death all my Estate should be equally divided among my 12 children or the representatives of such that may be deceased at my death.

Therefore appoint my said executors, trustees to divide my estate as follows to wit: that my whole Estate should be appropriated so as to afford a comfortable support to my wife during her life, and at her death either by sale division in lots or otherwise at the descretion of my said Executors to be divided into twelve equal parts, that my said executors shall deliver to such of my sons their shares and shall so settle on each of my daughters and their lawful heirs their respective shares in such manner so that their respective husbands shall have controll over said distributive shares and that it shall not be used for debts or contracts unless he gives sufficient security for the same to be appropriated to the support of my said daughters and their issue, agreeable to the true intent and measure of this my will before the said division should be so made I trust my said Executors after paying all my lawful debts and funeral expenses do retain (one hundred?) fifty dollars as a small consideration for their services and trouble.

And I declare this my last will being on my (perfect time?). this 28th. day of Feruary 1807 as witnessed my hand and seal in presence of us being first called on the testator to witness the same.

   Know all men by these presents that I Thomas West of the County of Chatham in the State of North Carolina, farmer, having an intention of removing to the Western Country and being possessed of land in the said County in fee simple and also of diverse Chattel property which I cannot now satisfactorily dispose of I therefore hereby empower my truly and well beloved son Jesse West of said County and State my true and lawful attorney for me and in my name to dispose of for my use and benefit all my property real and personal which I shall have undisposed of when I remove and particularly my land on dry Creek supposed to contain about 225 acres adjoining Mrs. Lutterloh's and Edward Jones'z which land I bought of Zachariah Martin and also 100 acres of land adjoining other lands of Edward Jones which I purchased from the state agreeable to my grant for the same.  And I hereby empower my said attorney to dispose of the same and to give bills of sale, assurances, covenants and a deed or deeds in fee simple in my name or such other conveyance or conveyances as may be requisite to pass my interest in the same to the purchaser thereof with a special warranty and covenant of warranty for a good and sufficient title to the same against all persons, but the heirs of the Earl of Granville - And I hereby acknowledge all the acts and deeds of my attorney aforesaid which he shall or may lawfully do in the promises to be my act and binding on me and my heirs my executor and adm.

I did realize my lack of zeroing in on a more accurate estimate of birth year for Thomas West, Jr. (1744 or earlier) and until just a few days ago, I had not thought too much about the 1760 date of John Hall's will. That fact makes the likelihood of Lucy being Thomas West, Jr's wife a lot lower (assuming the Lucy that is mentioned in the land transation as wife of Thomas West - is the Lucy West mentioned in John Hall's Will)!!!

The two together make up the 190 acres bought in 1769 and sold in 1774.

There are several deeds for a Thomas West from 1750's to 1800 (rough estimate of time span). Only one lists a spouse (the 1774 Indenture only!). So, which one is this? Sr., Jr. or mystery 3rd. Thomas? I will send you other Indentures and recorded documents for these two (3) men as I have time. JGW

Categories: North Carolina West Research Ben West has transcribed the Granville Co., NC Tax Lists from 1753 thru 1765 (a few years are missing). I wanted to make comment about this information and hope to get others involved with some research and discussion of this information: WE HAD PREVIOUSLY THOUGHT THAT... Richard was the oldest son born 1739 or earlier, while Thomas was the next son born 1744 or earlier. Now, these earlier tax lists seem to indicate that Thomas was born 1738 or earlier and may be the oldest son! In 1758 is Thomas West [Junior] the constable? How old would he need to be to be a constable in 1758? At least 16, 18, 20 or 21? If 21 years old, Thomas (the 1758 constable) had to be born 1737 or earlier! But by 1760 and 1761, we see Tom Jr. listed with his father again - WITH A THIRD Thomas West listed - who is he? Then to make all even more confusing, 1762 only lists two Thomas West (father & son) with the father as constable this time! CAN ANYONE SUGGEST WHAT MAY BE THE STORY HERE? - JGW
