[Page 430] This Indenture made the fifteenth day of November in the year of our Lord 1836. Between Jepthah West, Henry Brewer & Nancy his wife, William Brewer, Thomas Brewer, Candis Williams and Amos Williams, Joseph Meacham & Mary his wife, William Meacham & Sarah his wife, Charles West, Philip E. West, Isaac & Susannah Henderson, Jesse West, James Simmons and Caty his wife and Wm. Allder & Keziah his wife formerly Brewer, Moridy West, Wm. Jones & Mary Jones his wife late Mary West heirs of Richard West dec'd. & all heirs of Thomas West deceased and William Duprey, Junr. By Abraham Stites a Commissioner in Chancery of the first part and John West of the second part. Witnessed that whereas [Page 431] in a certain suit in Chancery depending in the Christian Circuit Court wherein said John West is complainant & the heirs etc. of Thomas West are defendants rendered at the August term 1836 of said court. It was among other things decreed that A. Stites be appointed a Commissioner to convey to John West all the right title & interest of the heirs of Thomas West by quit claim deed in & to the said tract of land in the bill named on which Tho. West died & the same conveyed by Edmund Taylor to said Thos. West by deed bearing date 19th. June 1819. Each party from this time out to pay their own cost & all fees coming agt. John West from the Christian Clks. Office not paid by John West on or before the 30 July 1836 to be paid by defts. & the bill dismissed without prejudice as to John West's claim in & to the personal estate & slaves of his brother Tho. West deceased. Said Comr. to report, etc. Now, therefore, this indenture witnesseth that the said parties of the first part by the said Commissioner for & in consideration of the promises do quit claim grant & convey unto the said John West & his heirs & assigns all their right title & interest of in & to a certain tract or parcel of land lying and being in the County of Christian and State of Kentucky on the waters of Pond river and bounded as follows - viz - Beginning at two sugar trees on the bank of the creek near the mouth of the sugar Camp branch, thence up the branch with the meanders thereof North 71 west one hundred poles to a black oak thence North 17 east fifty eight poles to a stone, thence 73 east one hundred & seventy eight and Eight tenths poles to a white oak, thence south 17 west two hundred and thirty two poles to a Spanish oak, thence North 69 west one hundred and eight poles to a stake, thence north Eighteen east crossing the creek sixteen poles to a stake, thence down the Creek with the meanders thereof to the beginning containing two hundred and five acres be the same more or less being the same tract conveyed by Edmund Taylor to Thomas West & referred to in said decree to have and to hold said tract of land to the said John West & his heirs & assigns to his & their side forever. In witness thereof the parties of the first part have hereto set their hands & seals this day first herein written ~

Commonwealth of Kentucky } Christian Circuit Court Etc. } I, John W. Phelps, Clerk of the Christian Circuit Court aforesaid do hereby certify that on the 17th. day of November 1836 in the November term of said Court at the Court house of Christian County the within deed from Abram Stites Commissioner therein named to John West was produced in Court by the said Commissioner and was by him acknowledged to be his act & deed and was admitted to record among the proceedings of said Court and was ordered to be certified and is hereby certified accordingly to the Clerk of the Christian County Court for further record given under my hand this 17th. day of November 1836 and in the 45th. year of the Commonwealth.

County of Christian, towit } I, Abraham Stites, the Clerk of the County Court of Christian County aforesaid, do certify that this deed from the heirs of Thomas West dec'd & others to John West with the certificate thereon written was on this day produced to me in my office in behalf of the grantee & ordered to be recorded. Whereupon the said deed & certificate together with the foregoing certificate hath been duly admitted to record in my office given under my hand the 30th. day of December 1837.
