Will and Testament of Samuel Kelsey

• Washington County, Tennessee. Will Book A

I, Samuel Kelsay, of the County of Washington and the territory of the United States, South of the river Ohio, being sick and weak of body, but of sound mind and memory, blessed be God, and calling to mind the uncertainty of life and the certainty of death, do on this 23rd day of February A.D. 1795 make and ordain this my last will and testament in manner and form following:

First, I will that my just debts be fully satisfied and paid and the remainder of my estate to be dispersed of as follows –

Item, I give and bequeath unto my Sister Anna’s sons, Samuel Kelsay Nelson and Henry Nelson, and to their heirs, my two tracts of land adjoining each other, in the County of Washington, on Boons Creek, together with all hereditanents and appurtenances thereunto belonging, to be equally divided between them.

Item, I give unto my Sister Anna’s son, Samuel Kelsay Nelson, the sum of twenty five pounds, Virginia Currency, to be paid out in a horse and saddle.

Item, I give and bequeath unto my three Brothers, William, Moses and John Kelsay and my Sister Margaret Peoples, the two last tons of iron, due from Henry Harkleroad of Sullivan County, to me, to be equally divided among them

Item, I give and bequeath unto my Brother, David Kelsay, all that may be due me, by note bond or otherwise, at the time of my decease.

Item, I give and bequeath unto my two nieces, Elizabeth and Mary Peoples, the sum of sixteen pounds, Virginia Currency, due from their Father, Nathan Peoples, to me, to be equally divided between them.

I give and bequeath unto my brother Moses’ son, John Kelsay, all that may be due on a certain bond, in my possession, on said John Kelsay, to be equally divided between himself and his Brother, Samuel Kelsay.

I give and bequeath unto my Sister, Anna Nelson, all the remainder of my estate, to be disposed of, at her discretion, among her children.

And, I do hereby constitute and appoint my Brother William Kelsay and my Brother-in-law, Henry Nelson, my executors of this my last will and testament.

And, I do hereby revoke and disannul all and every other will or wills, testament or testaments, declaring and publishing and ratifying this to be my last will and testament, and none other.

Signed, sealed and acknowledged by said Samuel Kelsay as his last will and testament before us, who were all present at the signing, sealing and acknowledging thereof.
