Will of Mary Johnston, Champaign County, Ohio, March 1823. Proved October term 1823.

"Be it Remembered that now here (To wit) at a court of common Pleas held at Urbana in County of Champaign and State of Ohio before the Honorable Joseph H. Crane Esquire President and Samuel Hitt, James Smith and Abram R. Colwell Esquires his associates: Judges of Said court, of the Term of October one thousand Eight Hundred and Twenty three, the last Will and Testament of Mary Johnston deceased was produced in open court by Douglass Winn the Executor therein named and proven by the oaths of John G. Colwell and Aquilla Bishop two of the subscribing witnesses thereto. And thereupon the Executor aforesaid was qualified and the will ordered to be recorded. Which Will, in words and figures, reads as follows (To wit)

    "In the Name of God Amen: I Mary Johnston of Champaign County and State of Ohio being of Sound Mind and memory, hereby make and ordain this my last Will and Testament in manner and form following:
    "Item 1st. I give devise and bequeath to the children of my Son Edward Johnston deceased (viz) Martha, Noel, Delilah, William, Nancy, Alfred and Mary a Bond made 24th June 1812 by Edward Johnston Jr. to Edward Johnston Senr. and Mary Johnston his wife, for a thousand dollars, which Bond was to be discharged by Said Edward Junior's keeping Said Edward Senior and Mary his wife in the peaceable possession of the dwelling house (now occupied by Gerrard McKinnie and his wife and my Said Son's children) and one half the farm whereon Said dwelling house Stands, during our natural lifes. It is my will and desire that my Grandchildren above named shall have all the rents that may be due on Said Bond until the year one thousand Eight hundred and Twenty two. To them my Said grandchildren and their heirs I give and bequeath the Same.
    "Item 2nd. It is my desire that there shall not be an Inventory of my estate made, but that all the monies and property that belong to the Same, after all my just debts are paid, my funeral and other necessary expenses all discharged, shall be equally divided amongst my children (viz) Mary Osborn, Nancy Osborn, James Johnston, Jesse Johnston, Elizabeth Henry, Milly Dunlap, and Patsey Osborn. And an Eighth part of the same be equally divided amongst the heirs of my Son Alexander Johnston deceased. To them my Said children and Grandchildren I give and bequeath the same.
    "Item 3rd. I give and bequeath to my daughter Nancy Osborn all the rents arising from my part of the farm (Secured to me by the above mentioned Bond) from the commencement of the year Eighteen Hundred and Twenty two. The above mentioned rents I give and bequeath to my Said daughter Nancy in consideration of the care she has taken of me and the money expended by her husband Levi Osborn for my benefit.
    "Item 4th. It is my desire that my body be decently interred near the place where the body of my deceased husband was buried.
    "Lastly, I constitute and appoint Douglas J. Winn Executor of this my last Will and Testament hereby revoking all other Wills by me made, and confirming this alone to be my last Will, which I Seal Publish and declare this Twenty first day of March in the year of our Lord Christ one thousand Eight Hundred and twenty three.

"Signed Sealed and acknowledged Mary Johnston, her X mark"
