There was a problem with the estate of her late husband and the children were removed from Judith and Joseph Carpenter's custody. Her sons James and Joseph were placed under the guardianship of their uncle, Captain David Scott, the youngest brother of John Scott. Her son Jacob (known as Jacob Scott of Red Bridge) was under the guardianship of his uncle, John Davis, brother of Judith. Judith's brother, John Davis, was the Administrator of John Scott estate
