Will Transcript
- In the Name of God Amen, I Joshua Evans of the County of Loudoun being Sick & Weak but of sound Sense & Memory Calling to mind, that it is appointed unto all men Once to Dye do hereby make & Ordain this my last Will & Testament in Manner & form following ~
- Imprimis first of all my Desire is that Executors hereafter Named, pay all my Debts & funeral Expenses
- item I give & Bequeath unto my loving Wife Martha Evans during her Natural life (Provided she degas? [stays?] my Widow) one Room in the House I now live in which is Calld. her room my desire also is that my Executors Build for her a shed Room adjoining her Room fourteen by twelve in the Clear with a Brick or Stone Chimney & to Finish the whole in a Decent Manner also to pay her Six pounds as Soon as it Can be had after my Decease and Twelve pounds yearly and very Year afterwards she is also to have her Choice of the Milk Cows now in the yard & should that Cow dye by accident my Executors out of my Estate is always to keep her up one good Cow she is also to be paid yearly & every Year Twelve Bushels of Wheat, Twelve bushels of Rye & Twelve Bushels of Indian Corn, One hundred pounds of good Beef & one hundred & fifty pounds of good Pork & two Bushels of Salt. She is also to have my Bed & furniture the Corner Cobbord of Walnut Table, three chairs all my Pewter & Delph Maze, my small Pot & small Kettle, my Chest & Clock, she is also to have her Fire Wood brought to the Door, the use of the old garden & the liberty of a yard & outlet she is also to have my Riding Mare, which my Executors together with the milch cow is to fodder &c. and keep in good Order for the uses Indended. She is also to have the liberty of the Orchards on the plantation so far as she will want for her own use
- Item I give to my Sisters son William Thomas (to receive them when he shall arrive at the age of Twenty one Years) all of my Black Smiths Tools ~
- Item I give to my Brother William Evans all my Wearing Apparel also (during his Natural life) my large Family Chest & after his Decease my Desire is that his Son John Evans shall have it, likewise to my Brother William Evans my Waggon & Gears.
- Item. I give to my Brother David Evans' Widow in Pennsylvania to Assist her in Raising and Schooling her Children all the Debts due me there by Bond, Note or open Account ~
- Item my desire is that the Remainder & Residue of my Estate be sold at Publick Sale at the Discretion of my Exors. and the money arising by the Sale together with what shall be raised from my outstanding Debts & the Rents of my land be put at Interest which Interest is to be Divide Yearly equally Between my Brother William Evans & my Sisters Emmel Thomas & Mary Gardner during their Natural lives and upon the Death of either of them still to be Divided Between the Survivors & so to Continue to the longest liver and the Principle after their Decease I give to my Brothers Son John Evans.
- Item I give & Bequeath to my Brothers son John Evans all my real Estate to him & the Heirs of his Body lawfully Begotten forever ~
- Item my desire is that in case my Wife should Marry after my Decease that what I have before allotted her Cease & that she shall only have her Cow, Bed, Tabke & Pewter & three Pounds Instead of Twelve Yearly.
- Item whereas I am Impowered to Receive the Rents of the lands belonging to my Brother David Evans' Children in Pennsylvania and after my Decease the Tenants may be at a loss to pay there [their] Rents to, I Direct that my Executor receive them yearly & Remit them to the Widow & Executors of my Brother David Dec'd. in Pennsylvania.
- item my Desire is that my Executors do not make either of my Servants John Bevins & Thomas Robinson pay for there [their] Runaway time of any of the expenses attending their being Brought home ~ my desire & Request is that Richard Spurr, Robert Fryar, Roger Wigganton & my Wife Martha Evans as Executors of this my last Will & Testament

- At a Court held for Loudoun Count the 9th day of November 1773
- This last Will & Testament of Joshua Evans Deced. was Proved by the Oath of William Harper & Robert Scott Two of the Witnesses thereto & the Widow of the said Decedent Personally appearing renounced all Advantage of the Provision made for her by the said Will * Prayed of the Court in lieu thereof to Assign her Dower of her said Husbands Estate, Whereupon it was ordered that William Evans the heir at Law should be summoned to contest the validity of the said Will *c. and at a Court continued and held The 10th Day of November 1773 on the motion of Robert Fryer & Richard Spurr two of the Executors therein Named Certificate is granted them for obtaining a Probate thereof in due form they having sworn to the same & Given Bond & Security according to Law, and at another Court held for the said county April the 14th 1774. This said Summons was Discontinued and the Will Ordered to be Recorded.

- 1 Oct. 1767, Loudoun County, VA Deed Book E, pg. 170: Evans with Evans, Articles of Agreement: Articles of agreements made and done this thirty first Day of October in the Year of our Lord one thousand seven hundred and sixty seven, Between John Evans of the County of Loudoun and Colony of Virginia and Griffith Evans his Son of the other part of said County & Province aforesaid that is to say the said John Evans and his Wife is to live and dwell in the House they now are and enjoy all the Privilege which they now do during their Natural Life without any let hindrance or molestation whatsoever and to the above agreement the said Griffith Evans do bind himself his Heirs and Assigns in the Penal Sun of one hundred Pounds Current of Virginia to the John Evans or his Heirs or Assigns. In Witness whereof the said Griffith Evans hath hereunto set his Hand & Seal the Day and Year first above written.

- 24 November 1772, Loudoun Order Book E, p. 444. Upon the Petition of William Horseman for leave to turn the Road leading from Evans Shop at Sugarland run to the Broadrun Church. Ordered that John Piles, Joshua Evans, Richard Spurr and James Whaley or any three who being first duly Qualified do View the most Convenient way for Turning the said to the Advantage of the Petition and make report thereof to the Court of the Conveniencies and inconveniencies that may attend the same. Richard Spurr, Joshua Evans, and James Whaley who were appointed to View the way for turning the Road by William Horsemans now make their report “that they way they have Viewed is near the same Distance at the present, and that the way may be made equally as good, except a small Hollow Place which may be made Good.” Ordered that the same be Established, and that the said Horseman may have leave to stop up the old road.
