      1860 Census Decatur Co., Clay Twp., male, age 39, farmer, real/personal property $6500/$500, literate, family 0130. Stated that birthplace was Indiana. Living with the family (Rebecca, Eliza, Mary and Martha) is Elizabeth Pumphrey, a female, age 35, born IN, literate. Also, it lists Martha, female, age 2, born IN (if this is Joseph and Rebecca's Martha her birth should be about 1858).

     Joseph M. Pumphrey, living in Decatur County (southeastern Indiana) had first married Elizabeth Kimmell, a daughter of Peter Kimmell, and following her death, married Rebecca Ray, also in Decatur County, on 14 June 1854. 
     In March of 1863 Joseph purchased 320 acres in Wildcat Township, Tipton County, IN. On 25 Mar, from Thomas H. French he purchased 160 acres (the East 1/2 of the NorthWest 1/4 and the West 1/2 of the NorthEast 1/4 of Section 4, Township 22 North, of Range 5 East), and receipt was acknowledged for $1950.00. The General Index of Mortgages, Book 2, page 573 lists a mortgage that was satisfied on 2 Mar 1864. On 31 Mar he purchased 160 acres (the SW 1/4 of S3,T22N, R5E) from James B and Sarah Ann Fouch. For this land he paid $2800 and took over two taxing mortgages for $300 each. On 8 Feb 1864. he sold 120 acres (40 acres for $480.00 each) in Section 3 to three of his children from his previous marriage to Elizabeth Kimmell; George W., Eliza Jane, and Sarah E. 
     Joseph M. and Rebecca had four children, but only one, a son Joseph Marion, born 8 Sep 1865 would survive childhood. The year after Joseph Marion's birth, in 1866 at age 45, Joseph M. died.
     Rebecca remarried twice, William Stocksdale in 1867, and the Rev. Joseph VanBriggle in 1874. As the son was only a year old at the death of Joseph M., the remarriage of Rebecca, and the move to Prairie Township helps explain the later lack of any family knowledge of Joseph M.'s life.

Stockdale & Chase vs. Pumphrey & Alley

Pleas before the Honorable William Garver Judge of the Court of Common Pleas of Tipton County Indiana at a term thereof began and held at the Courthouse in said County and State on Monday May the 30th 1867. On Monday May the 30th 1867 and first Special day of said term of Said Court the following proceedings were herd in the cause of

	Come now the plaintiffs by O & D, their attorneys and prove to the Court that a summons issued out of this Court in this cause has been duly served upon said defendent more than ten day before the first day of our present term and on motion of William S. Alley the adult defendent is three times called and comes not but herein wholy makes default and it is proven to the Court that the defendent Joseph M. & Mary E. Pumphrey and Louisa E. Alley, are minors and on motion Nick Vanhorn an attorney of this Court is appointed guardians adlitem for said infants and is duly sworn as such and he is now invested to and files his answer for said infants and the cause being at issue is submitted to the Court for trial upon the evidence adduced whereupon the Courts finds that all the material alegations in Said Complaint are true and that the plaintiffs are entitled to partition as preyed for. That the plaintiff Rebeca Stockdale is entitled to the 1/3 part in value of the following described Real Estate in Tipton County Indiana the South  West qr of Section 3 in Township 22 Range 5 East containing 160 acres that Sarah E Chase and George W. Pumphrey are entitled to the 1/5 part of the2/3 part in value thereof  each it is therefore considered by the Court that partition of said lands be made among the owners thereof according to their right and on portion. Arthur M. Legg, Bengamin F. Legg and John Summers are appointed & Commissioned to make partition of said lands and set off to said pliantiffs in severalty their respective shares and they are ordered before proceeding to make petition to take an oath to faithfully discharge of their duties and to make report at the present term of this court. 
And on Friday May 28th 1867 and 8th day said term of said court the following Proceedings were had in said cause. To wit Come now the parties and now also come the commissioners appointed to make partition and now make file and acknowledge in open court their report in this cause in the words and figures following. We the undersigned commissioners appointed by the Tipton Court of Common Pleas to make partition of the following described lands in Tipton County Indiana to wit. The South West quarter of Section 3 in Township 22 Range No 5 East containing 160 acres more of less would respectively submit the following report. 
1st We assign and set off unto Rebeca Stockdale in full and fee simple as her full and equal 1/3 part in value of the above discribed lands the following to wit. Beginning at the South West quarter of Section 3 in Township 22 in Range 5 East thence east 86 poles and 7 ¼ feet thence North 87 poles, thence West 86 poles and 7 ¼ feet then South 87 poles to the place of beginning, containingt 47 acres more of less. 
2nd we assign and set off to Sarah E . Chase in full and in fee simple as her full and equal 2/15 parts in value of the above divided lands the following to wit 24 acres more or less off of the whole of the North side of the South West quarter of Section No 3 in Township No 22 Range 5 East  
3rd We assign and set off to George W. Pumphrey in full and in fee simple as his full and equal 2/15 parts in value of the above discribed lands the following to wit. Beginning forty nine (49) poles South of the North West corner of the South West quarter of Section no 3 in Township No 22 in Range No 5 East thence South twenty four poles thence East 160 Poles thence North 24 Poles thence west 160 Poles to the place of beginning containing twenty acres more or less. 
4th We assign and set off to Mary E. Pumphrey in full and fee simple as her full and equal 2/15 parts in value of the above discribed lands the following to wit. Beginning 34 Poles and 15 1/4 feet West of the South East Corner of the South West quarter of Section 3 in Township No 22 in Range 5 East Thence North 87 Poles Thence West 38 Poles and 10 ¼ feet  [Thence South 87 Poles Thence East 38 Poles 10 ¼ feet] to the place of beginning containing twenty one (21) acres more of less.
5th We assign and set off to Joseph M. Pumphrey in full and in fee simple as his full and equal 2/15 parts in full value of the above discribed lands the following to wit Beginning at the South East Corner of the South West quarter of Section No 3 in Township No 22 in Range No 5 East. Thence North 87 poles thence West 34 Poles 15 ¼ feet thence South 87 Poles thence East 34 Poles 15 ¼ feet to the place of beginning containing 19 acres more or less.
6th  We assign and set off to Louisa E. Alley in full and in fee simple as her full and equal 2/15 parts in value of the above discribed lands the following to wit. Beginning 24 Poles South of the North West corner of the South West Quarter of Section No 3 in Township 22 in Range 5 East thence South 25 Poles thence East 160 Poles thence North 25 Poles thence West 160 Poles to the place of beginning containing 25 acres more of less. These several land and areas to be in proportion to the bounds' and areas of the above discribed quarter section and all in accordance with Subjoined Platt all of which is respectfully submitted.
