NOT to be confused with John L. "Tobey" Price (1740-abt. 1817), son of John Price and Ann Younger. Some researchers have confused the two and there are many erroneous trees on the internet claiming this to be the same person. Please proceed with caution and consult primary sources.

Will Abstract

Will of John Price of the County of Cumberland.
I give and devise to my son William Price, my plantation where on I now live, also the first choice of negroe, a yoke of Oxen and a ___. I also give to my said son William one third part of all my stock of all kind whatsoever, also one third part of my household and kitchen furniture.
Secondly I give to my daughter Henney Isso? the second choice negroes, also a third of the stock also furniture, in like manner as I have devised to my son William.
3dly, I give to my daughter Pheby Lewis a negro woman Sarah and her increase, also one third of my Stock and furniture in like manner with Henney and William.
4thly. It is my will and desire that after the before mentioned devises to my three children, before mentioned and after the payment of all my just debts, that the remainder of my property be divided between the rest of my Children, in an equal and equitable manner.
I also appoint my son William Price, and my neighbor Thomas M. Walton, my Executors, to this my last Will and Testament made this 28 day of July in the year of our Lord one thousand eight hundred and eighteen.

At a Court held for Cumberland County the 22nd day of November 1819.
This last will and testament of John Price deceased was exhibited in Court and proved by James Stratton and John Gaula, two of the witnesses thereto, and ordered to be recorded ~ And on motion of John I Reynolds who made oath according to law, the administration of the Estate of the said John Price deceased is granted him with the will annexed the Executors named in said will having to the satisfactory of the court refused the execution of same, who entered into bond, with security according to law.

John Price vs. Executors of Joseph Price, Dec'd, Cumberland County, Virginia, 1791:
Know all men by these Presents that I John Price of Cumberland County are held and firmly bound unto Joseph Palmore, Thomas Guenter and Mary Flippen of Buckingham County and William Rowton of Charlotte County and Francis Armstead of Cumberland County in the full and Just Sum of one Thousand Pounds Current money of Virginia to be paid unto the said Joseph Palmore, Thomas Gunter, Mary Flippen, William Rowton and Francis Armstead their Certain Attorney their Heirs Executors Administrators or Assigns followeth payment will and truly to be made I bind myself my heirs Executors and Admnistrators firmly by these presents Sealed with my Seals and Dated this Twenty Eight Day of November Anno Domini one Thousand seven hundred and ninety one.
Whereas a suit at law is Commenced by the aforesaid John Price against the Executors of Joseph Price Dec'd, ___ or a Negro boy left to his son by the sd. Jos. Price Dec'd and fifty Pounds Cash Reserved for the Sd. John Price by the Sd. Jos. Price Dec'd and the sd. John Price hath agreed with Joseph Palmore, Thomas Gunter, Mary Flippin, William Rowton and Francis Armstead legatees of the said Joseph Price Dec'd to Dismiss the sd. Suit and have the same left to Reference the sd. John Price to Choose one of the Referces and Francis Armstead the other and if they cannot agree for them to choose the third.
The Condition of the above obligation is such that if the above bound John Price his heirs & Shall and Do well and truly Comply with and Dismiss the sd. Suit and have the Same left to Reference as Above Receted? and Abide by the award of the sd. Referes then the above Obligation to be Void or otherwise to Remain in full force and Virtuee.

Know all men by these presents that we Thomas Walton & Edward Walton of the County of Cumberland in Virginia for divers and causes have made ordained: constitute and appoint for our selves jointly John Price living in the county of Prince Edward in the State of Virginia our true and lawful Attorney for us in our name. Jointly as the case may be or require to direct any lowcation or lowcatinos survey or surveys of land we may have to make in the District of Kentucky, and the same as well as any that have heretofore been made for us in that district to defend protect against any injury or incroachments that has been or may be made to attempted thereon, hereby given to our said Attorney full power and authority for us Jointly to ask, demand, sue, recover, and receive, from all and every person and persons whatsoever all lands which may be unjustly withheld from us, and all sums of money which of right to us accrues for damages in consiquence of any injury to or encroachments upon any such lands, hereby ratifying and confirming whatever our said Attorney may do in the premises as fully as if the same were done by us personally.
