Will Transcript

Adair County, KY Fabruary 7th 1837
In the name of God amen. I John Patterson of the above County and State being poorly in body but sound in mind, and memory do make and ordain this my last will and testament revoking all others. To wit, I desire all my just debts to be paid as soon as it can be conveniently done.
I desire that my dear wife Sally Patterson and all the children now with me, To Wit: Avire Patterson, John Newton Patterson, Blackmore Patterson, Amanda Patterson, Menise Patterson remain with their mother on this place until sich time as any of them become of age or wishes to go to themselves and they are then the girls to receive a bed and furniture, cow and other property such a[s] can be spared from the general family then living with their mother at this place to the amount of one hundred twenty dollars in property saddle, and household furniture? and whereas I gave to my daughter Nancy that married Benjamin Wilcox in property to the amount of two hundred and twenty dollars in property worth at that time besides one black girl named Lucy worth three hundred dollars which is more than I am able to give to each of my other children at this time I therefore give and bequeath to her husband one dollar.
I also give to my daughter Polly that married James W. Findlay one black girl named Mary also beds, house and kitchen furniture, cow and calf, sheep, hogs, saddle, bridle and other property towards keeping house more than I can give to my other daughters I do therefore give, will, and bequeath her and husband one dollar.
I do also gave, and bequeath to my two oldest sons Thomas, and James Patterson all my lands that are deeded and patented [on] Madison Creek, and one entry surveyed b[y?] William McNeely adjoining the land the[y] live on all I gave them its in four difant [different?] surveys all adjoining that which the[y?] live on Thomas, and James are to be equal in said lands and to do with them as they may see proper.
James is to pay Thomas for improvements Thomas made before James went to himself I have giving said boys Thomas and James one horse each saddle and bridle worth seventy five dollars each this is all I can in justice to my other children gave them.
I gave and bequeath to my dear wife Sally Patterson during her natural life the traces of land and plantation I live on to be a support to her during live & the children under age if John Newton or Blackmore see proper to settle and to to themselves the that should marries first can settle on the Findley place and have as hereafter named [To wit] Beginning on the Northeast line of my lands that I live on near a little branch that empties into what the family calls the rocklick branch and make a corner and then ran a straight line frmo that to about four, or five, rods west of a chesnut tree that is in the lane where there is at this time a pair of bars thence straight the same coarse to the south line of my lands or out side thence with said line round the Findlay tract and others to the beginning near the lick branch this will include the lands I own east of the above named line throw [through] the plantation by the chesnut tree the lane. The tract or tracts of land I now live on not mentioned or before named.
I will and bequeath to my dear wife Sally during her natural life for a home and support to her and chldren till the[y] become of age or leave her and go to themselves or remain single and which of my youngest sons John Newton, or Blackmoore stays, and takes care of their mother during her natural life and their sisters that is Evire, Amanda and Menise untill they all leave their mother and go to themselves elsewhere I say that son that son that performes that duty faithfully to him I give and bequeath the aforesaid track tracks [tracts] I now live on all the lands west of the above mentioned line by the chesnut in the lane at the decese [decease] of their mother. Isyphena that married Harrison Kenaird her got part of what I allow her the balance she is to receive after my decese [decease] as soon as can well be spared from the family.
I do solemnly allow my black woman Sarah to live on the place with my wife during her natural live to aid, assist here and if she Sarah should out live her mistress then she may choose which of the youngest girls to live with during her live the two children that Sarah has now and any more she may have I will that the[y] be divided Equally amongst my four youngest daughters and if there should not be one black for each of the girls alluded to the[y] can draw lots and them that gets pay to the others in equal proportion or if the said Sarah should have more children or four with the two she has home now the[n] I allow the girls each if not as mentioned above so that each of the four give named fare as equal can this be my desire.
My books I do allow to stay with my wife for the use of the family untill such time as the youngest son Blackmoore is of age then my executors to divide them amongst my four sons equally as the[y] can I do bequeath to each of my daughters one bible and testament to John N. Patterson one testament in large print it did onst belong to my parents the[y] brought it from Ireland also the Blackmoore my shaving glafs that was a present to me when young the same to keep as long as he sees proper the four girls each of them I do allow to have Wats Psalms and hymns as soon as the[y] can well be got or sent for as my I allow to stay with the use of the family and to keep all the papprs [papers] in as may be necessary my gun I allow for the benefit of this farm untill such time as the youngest son is of age then all the boys cast lots for her and that one that she salls to to keep her.
It is my desire that my executors hereafter named will sell either at public or private sell such property as can well be spared from the ganeral family that is living with their mother and under age the money arising therefrom to pay my just debts whis is little the balance to go to the benefit of my dear wife, my children with their schooling the youngest of them ?
It is my most solemn an[d] ernest desire that if any dispute or misunderstanding should arise among my children or otherwise as to the meaning, or construction of this my will and testament I do solemnly protest against it ever going to Court or law about it but it shall be the duty of my executors in that case to choose two or more good well and qualified men determine the matter of dispute and their word shall be binding on all concerned.
Lastly I do hereby appoint my dear wife Sally Patterson, my friends John Beauchamp, Pleasant Whitlow, and William Frazer and James Patterson as my executors to this my last will, and testament as witness my hand and seal this the seventh of February eighteen hundred and thirty seven.

At a County Court began and held for the County of Adair at the courthouse in Columbia on Monday the 5th day of February 1838 this last will & testament of John Patterson deceased was proven by the oaths of James B. Wallbert & Samuel M. Moran subscribing witnesses thereto and ordered to be recorded, and on the motion of James Patterson one of the executors named in said will The execution thereof was granted him he having taken the oath required by law, and together with William F. Grady, Hesekiah Price, James P. Walbert, Samuel M. Moran his security executed & acknowledged bond in the penal sum of two thousand dollars conditioned as the law directs.

This Indenture this 17th day or March 18[04] Between Joseph Miller and Betsy his wife the one part and John Patterson of the other part witnesseth that the said Joseph Millar & Betsy his wife for and in consideration of the sum of one hundred pounds to them in hand paid the receipt whereof they do hereby acknowledge have granted bargained and sold & by these presents do well and convey unto the said John Patterson his Heirs & g. One hundred acres of land on the Pettitt? fork of Russells Creek and County of Adair & State of Kentucky and bounded as follows (To wit) Beginning at a buckeye and two Sugartrees thence South 45 E127 poles to a hickory black oak & white thorn thence N. 45° E127 poles to a hickery dogwood and black oak thence N45° W 127 poles to a poplar and two Sugar trees On the Old line thence with said line S45° W127 poles to the Begining with its appurtenances to have and to hold the said tract or parcel of land with its appurtenances be the same more or less unto him the said John [Patterson] his heirs and Assigns forever to his and their only proper use and behoof and the said Joseph & Betsy for themselves their heirs & do further covenant and agree to and with the said John [Patterson] his heirs & Assigns that the aforesaid tract of land with its appurtenances they will warrant and forever defend against the claim or claims of all person or persons whatsoever pretending to claim the same.

This Indenture made this 19th day of August in the year Eighteen Hundred and Eight between Joseph Walker and Hetty his Wife of the County of Adair of the One part and John Patterson of the County aforesaid of the Other part and State of Kentucky Witnesseth that the said Joseph & Hetty for and in consideration of the sum of One hundred pounds to him in hand paid at or before the selling and delivery of these presents the Receipt Whereof do hereby acknowledge have granted bargained and Sold & by these presents to grant bargain & Sell unto the said John [Patterson] One certain tract or parcel of land Situate lying and being in teh County of Adair on Butlers fork of Russell Creek containing One hundred and thirty two acres and bounded as follows [boundaries omitted] in a line of George Elliott's Survey thencewith his line..... to have and to hold the said tract or parcel of land unto the said John Patterson his heirs and assigns forever to his and their only proper use and behoof and the said Joseph Walker and Hetty his wife for themselves and their heirs the tract or parcel of land....

Witnesseth that the said John Patterson for and in consideration of the sum of Seven Hundred & Twelve Dollars in hand paid the receipt whereof the said John [Patterson] doth hereby adknowledge have granted bargained & Sold and by these presents doth grant bargain & sell unto the said Robert Brafford his heirs and assigns a certain tract or parcel of land containing one hundred and thirty two acres Situate lying and being in the County of Adair On Butlers fork or Russels Creek and bounded as follows (To wit) Beginning at a beech on Butlers fork corner to John Patrick's Survey thence with his line North 20° West 15 poles to the beech thence west 20° South 8 poles thence East 20° North 8 poles to a Stake in the Old line thence North 20° West 144 Poles to a Beech in Seinon MCartees? line thence terth? his line South 47° West 64 poles to a beech & Hickory thence North 81° West One hundred and five poles to a beech & Sugartree corner to Rucker & Creels? For Value received I Blackmore Hughs of Adair County do by these presents bargain Sell & legally convey to Nancy Hughs Patterson and Mary Patterson the infant Daughters of Mr. John Patterson by his first wife. Jointly One negro Girl named Lucy being about Eleven Years of age with her increase Forever to the Sale use and behoof of the said Nancy & Mary & their Heirs forever And the said Blackmore Hughs do bind myself my Heirs & c. to warrant & Defend the title of said Negro Girl to the said Nancy H. & Mary Patterson as secure and inviolate to them & their Heirs forever. Given under my hand this 28th day of March in the Year of Our Lord One thousand Eithe Hundred & Ten.

    Dear Brother and sisters,

    By this I let you know that we received your letter which give us grate satisfaction to here from you (…?) move in this life. But believe me (sis/this?) it has afflicted us very much to here that you have lost your wife and likewise sister Polly to think that a cold and silent grave (grace?) should embrace (there hands?).

    I received your letter the 29 of June last. Dear brother I have wrote 4 or 5 letters to you but it appears to be a thing impossable for you to git them. I should have come to see you but hurry of buysness and urgance of afairs have hindred my willingness in the first place. Rebeckah has been sick very much since we have been married. We have two children both boys George Washington and John (B?) Nye. With her first one she lost her left brest and lay (quie?t) 4 months and bett (hole in letter - maybe bettered?) and then with the next she she lost her write brest. But they have both mended and she gives (seed or suds?) out of both. Sir it appears that it pleases god to keep us seperated from one another ever since I have been (hurried?) (by?) our family. We can’t (have?) no more at this time but write a few lines to each other. But I hope that we will one day meet face to face so that our joy may be filled. You need not to look for me this fall for I expect to start to Rusel County the 25th of this month in order to purchice a lot and a small track of land containing 150 akers that I have partly agreed for it is not more than one mile from the coast.
    I dwo (do?) think it will be the gratist place for me that I can find. The best kind of wheat is selling there for fifty cts and excelant water. I dwo expect to du grate bysness there if I (wonst) git (fixed?) there. I should be very glad if you would come and see us this fall if any of you can make it (….?) with out ingering your selves. I dwo expect you will find us in Russell County VA where the court house is now to be.

    I wrote a letter to Mr. James Kidmane (?) Kidmore (?) and have not rcvd any answer yet. I have no more.
