Will Transcript

Will of John Kincaid
In the name of God Amen. I John kincaid seinor of Marion County missouri being Sick and weake but of a Sound mind and disposing memory do make this my Last will and testament.
Item the 1st I give unto my son James D. kincaid the tract of Land on which I now live conting about two hundred acres with its apertainances to have and to hold to him and his heirs forever - with a small exception that Shall be made hereafter I also give unto James my negro man named Edmund.
Item 2nd I give unto my two Daughters Jane and Rachael the east end of my new building with ground for a garden and a Sufficency of timber for fire wood So long as they may Continue to live unmaried.
Item 3rd I give unto my Son John Kincaid my negro boy named Anderson all property heretofore given to my Children and not named in this will I Confirm the right thareof to be good.
Item 4th I give unto my Son Joseph kincaid the money which was paid for him to William Baugh for the negro which he bougt of Said baugh.
Item 5th I give unto my Son David C. kincaids two Sons william and Robert Kincaid my negro girl named Mary ~ to be under the Controll of thair mother and for her use and benefit during her lifetime.
Item 6th I give unto my four grandchildren the heirs of William Baugh fifty Dollars Each to be made out of my estate to be put out on in trust at not exceding ten or twelve percent until the heirs Come of age.
Item 7th it is my will that the balance of my estate if any be eaqually devided among my Children.
Item 8th if my daughter Polly harris become an inhabitant of this State it is my will that Shear in the division of my property but if not She has no part in the Said property.
Item 9th it is my will that my Son in lay Alfred Harris have two dollars out of my estate. N B. it is my will that if my daughter Polly Harris Should not become a resident of this State before the division of my property that She be excluded from having any part therein.
Last of all I apoint William M Kincaid and James D. Kincaid executors of this my last will and testament to act as the law directs, this 23rd Day of February in the year of our Lord and thousand eight hundred and thirty four.
