Greene Co. TN Deeds: 21 Oct 1818, This Indenture entered into this twenty first day of October one thousand Eight Hundred and Eighteen, Between John Gragg and William Gragg of the one part, and Hugh Melay of the other part all of the County of Greene and State of Tennessee. Witnesseth, that for and in Consideration of the sum of Six Hundred and Eighty five Dollars in hand paid the Receipt whereof is hereby acknowledged ~ the said John and William Gragg both arbained sold Granted aliend and Confirmed unto the said Hugh Meloy his Heirs and assigns, and by these presents do Bargain, Sell, Grant, alien? and Confirm unto the said Hugh Meloy heirs and assigns forever a certain Tract or parcel of Land, Lying and being in the said County of Greene on the south side of Nolachuckey River bounded as follows: ..., then four poles of ___ the same couse to a stake on the North side of a Tract Conveyed by Alexander Kelly to Robert Gragg Deceased, thence with the same, North Eighty seven and a fourth East, ....thence South Fifty two and a half west Ninety four poles to a Black oak on the open line of said Tract Conveyed by Alexander Kelly to Robert Gragg Deceased.... to the Beginning Containing one Hundred and Fifty three acres, (viz) John Gragg conveys on his part Fifty Three Acres, and William Gragg on his part one hundred acres, Together with all the woods, ways, waters, water-courses, profits, Commodidies, hereditaments and appurtenances to said Land Belonging or Right appertaining ~ Reversion and Reversions, Remainder and Remainders, Rents Issued and profits thereof, to have and to hold the aforesaid one Hundred and Fifty three acres of land, hereby sold and conveyed, and all the singular the premises, and every part and parcel thereof, with these and every their appurtenances to the said Hugh Meloy, and to the only proper use and Behoof of the said Hugh Meloy his Heirs and assigns forever, and the said John and William Gragg by these presents to convenant and agree with the said Hugh Meloy that the said Land now is and forever shall be clear of all Bargains, sales or Grants by them made, Rite of Power or any Incumbrance whatsoever So as to make unto the said Hugh Meloy a perfect Title or Estate of Inheritance in fee simple, and Lastly said John and William Gragg doth promise and agree to warrant and forever Defend such land against themselves their Heirs and Assigns to the said Hugh Meloy his Heirs and assigns forever. This Indenture made and entered into this Twenty fourth Day of July one Thousand Eight Hundred and Nineteen between George Cook and John Gragg Executors of the Estate of George Cook Deceased of the one part, and William Kilgore of the other part, all of the County of Greene and State of Tennessee. Witnesseth, that for and in Consideration of the sum of Three Thousand Two hundred and Eight four Dollars and Sixty Six Cents the Receipt whereof is hereby Acknowledged, the said George Cook and John Gragg Executors of the Estate of George Cook Deceased hath Bargained and sold and by these presents doth bargain, sell, alien, enforce and Confirm unto the said William Kilgore a Certain Tract or parcel of Land Lying and being in the said County of Greene on the south side of Nolachuckey River on Meadow Creek, Bounded as follows, [boundaries omitted] Containing Four Hundred Acres. - Together with all the woods, ways, waters, water-courses, profits, Commodities, hereditaments ~ appurtenances to the said Land belonging on in any wise appertaining, with the Reversion and Revisions, Remainder, Remainders, Rents, Issues & profits thereof and all the Estate Right, Title, Interest, property claim and Demand of him the said George Cook and John Gregg Executors of the Estate of George Cook Deceased their Heirs and assigns forever, of in and to the said Land and every part and parcel thereof Either in Leases, Equity, to have and to hold to him the said William Kilgore his Heirs and Assigns forever, against the Lawful claim of all and every person or persons whatever, will warrant and forever defend so as far as they are authorised by the Last Will and Testament of the said George Cook Deceased. Greene Co. TN Land Survey, 1824: By virtue of an Entry made in the Entry takers office in Greene County of No. 548 Dated December 4th 1824. I have surveyed John Gragg fifty acres of land on the waters of Charles Creek sough side of Nalachucky River. Beginning at a black oak a corner to William Gragg thence with his line North eighty seven East fifty one poles to a white oak thence North twenty eight East Seventy five poles to a stake on his old line thence North seventy two West eighteen poles to a hickory his corner thence North twenty poles to a black oak thence with a line with a line of his fifty - acre Survey West eighty poles to a black oak his corner thence a direct line to the Beginning. John Gregg dec'd, [proven] 7 June 1847, Mins 20, p. 340
In the name of God Amen, I John Gregg of Greene County in the State of Tennessee, and citizen of the same, being old and infirm in body but of sound mind and memory, for which I thank God, calling to mind the mortality of my body and knowing that it is appointed unto all men once to die do make ordain and declare this to be my last will and Testament revoking all others.
1st. I would return my soul to God who gave and recommend my body be buryed in a decent christian like manner. With regard to such worldly estate as God had been pleased to bless me with I dispose of in the following manner.
1st. I give and bequeath to my beloved wife Hannah the plantation whereon I now live with all the rents arising & profits arising from the same during her natural life or widowhood together with all my household and kitchen furniture, one horse saddle and bridle, two milk cow, all the stock of hogs on hand and ten dollars worth of book to be selected by herself out of my library.
2nd.I give and bequeath to Almira Jack fifteen dollars in money and that to be hers and her feirs forever.
3rd. I give and bequeath to my right grand children of the heirs of Saml. Gregg dec.d. (viz.) Elizabeth, Suse?, Esther, Hannah Jane, John, Margaret Amanda, Harriet Adaline, George & Finley four hundred and fifty dollars toe amount of a note I now hold on George M. Brown. It is my will that the sd. money be put out on interests and I give and bequeath to my daughter in law Susan C. Gregg the interest asising from the sd. money to aid her in raising her children and at her death the sd. $450 collars to be equally divided among sd. children.
My Executors herein after named is not required to take charge of sd. money. But I request my Friend Alexander Logan of Indiana to aid her in loaning sd. money and collecting est Interest.
4th. I give and bequeath to my son Marshall W. Gregg that part of the place whereon I now live designated by the following likes (vis.) Beginning with the meadows fence where it intersects with the line of George Cook and a Corner of George M. Browns tract, thence with sd. fence to the middle of the line, Thence with sd. Browns line till intersects with John Keyes line, Thence a west course with sd. Keyes line and running the original line sound sd. tract, together with two fifty Acre entries that I own joining sd. land to be his, in consideration of which bequest he is required to pay my other heirs the sum of eight hundred dollars in current Bank notes made equal to par and to ___ pair in the way hereafter specified.
5th. I give and bequeath to the trustees of Greenville College Gibbons history of the decline and fall of the Roman empire, and they are hereby required to deposit in the College library for the use of sd. College.
6th. It is my will that after the death of my wife my personal property be all sold, my first debts all paid and all the notes on hands ___ of which Western Prince ows $385.50 and Marshall W. Gregg $85.62½ together with the money arising from the sale of my property and any or all other debts that may be owing and my Executor is mowed? two years after the death of my wife to collect ad. money, at which time the eight hundred dollars that Marshall is owing is to be paid except 120 dollars that he has paid sons Kelly as a part of my estate and all the sd. money to be equally devided among my heirs hereafter named only George A. Gregg is to have forty dollars more than my other heirs Eliza Gregg, Rebecca Chambers, Ann Kelly, John Gregg, William Gregg & George A. Gregg.
My executors is requestd to pay the heirshp coming to Ann Kelly into her own hands and the same request is not to be liable to the payment of Jacob Kelly's debts while in the hands of my executor. The seventeen dollars paid by my son Samuel Gregg to Jacob & Ann Kelly as a part of their estor? I require my executor to repay to Susan Gregg o0ut of sd. Jacob & Ann Kelly's devide or part of my estate.
Finally I do hereby constirite and appoint my son Marshall W. Gregg my executor to execute my last will and testament.
