1910 Census Oregon, Malheur states he is married but there is no one living with him.
James W. and Amy may have had a son named Oscar. I had one listed under them but combined him with the John Oscar. Birth year for this Oscar would have been 1876.
Could this couple have had a son named James born in Nov. 1878? If so see Census record CNOR022. There IS a James born 1881.
On James' DC the birthplace of his father is listed as Virginia not W. Virginia.
In the Divorce James got custody of Ida 12 yrs, Oscar 9 yrs and Ada 8 yrs. In his Divorce with Amy it states that he deserted her. In his Divorce with Minerva it states that she deserted him.

Extract-planitiff is a resident of Malheur Co.Oregon and has been an actual bona fide resident and inhabitant of Malheur County Oregon, for more than one year next preceding the commencement of this suit.
That the defendant is a resident of Baker County Oregon and has been an actual bona fide resident of Baker County Oregon for the last past four months.
That the plaintiff and the defendant on the 2nd day of May 1897 at Westfall, Malheur County Oregon intermarried and ever since have been and now are husband and wife. That the defendant on or about the 1st day of October 1900 at my residence in Malheur County Oregon in disregard of her marital obligations, wrongfull and without cause therefor wilfully and intentionally and against plaintiff's will deserted this planitiff and abandoned plaintiff and refused to love with plaintif as his wife. Next of Kin and heirs in law and at law are: Mrs. Ida Millmon, residing at Boise, Idaho, age, 39 years; Oscar Westfall, residing at Salmon City, Idaho, age, 36 years; Page2 Mrs. Ada Wilson, residing at Westfall, Oregon, age, 34 years; a daughter of said deceased; James F. Westfall, residing at Westfall, Oregon, age, 32 years; a son of said deceased. James F. Westfall is 32 years old and is petitioning for Administrator of estate.
