Buried in Tole (Bud Holt) Cemetery in Wayne Co. The marker is very old and difficult to read and loggers have driven over the tombs as it is in the woods. Birth and death dates from the tombstone. Also from deposition made by James C. Queen regarding the estate of S.H and Martha Turnbo, October 21, 1887 found in the court records of Wayne County. He states " I was 70 years the 7th day of this month. I live on Beech Creek at the place known as the Jasine Robertson place, I have been a farmer all my life. I lived on Beech Creek thirty odd years, I was acquainted with S.H. Turnbo from his boyhood, I lived four mile from him at his death. I am well acquainted with Bud Turnbo, I think he could be easily overreached in a business transaction." He was named as a defendant in the case of Crockett Childers & M.J. Childers, citizens of Perry Co., TN regarding the estate of Mrs. Elizabeth Newburn, on August 25, 1890 In the matter of the estate of Hugh Turnbo, dated April 3, 1878, he appears to give testimony on January 16, 1879 and state "I am 60 years old and I am a farmer. He gives a statement in the case of G.W. Nunely vs. William Turn & I.N. Selph. James says "I have known Nunley for forty years and Selph about twenty one years. I lived for a number of years on an adjoining farm and have lived near him all this time. In the case of Elijah Warrington vs. Archie Prater, on December 2, 1892, James states " I am 73 years of age, a farmer and live on Beech Creek. From all his statements I find James Campbell Queen to be a highly articulate and well schooled compared to his contemporaries. He is consistent with his age.

TALLEY§ Indictment for Malicious Stabbing This day came the attorney General who prosecutes on behalf of the State and the defendant in proper person and said defendant being arraigned and charged on the Indictment in this behalf pleads not Guilty thereto and for his trail puts himself upon the Country and the attorney General doth the like Whereupon Came a jury of good and lawful men of the County of Wayne to wit Isaac GREGG John GRIMES James C. BIFFLE and Mary Ann GRIMES Exparte§ Petition to Sell land Be it remembered that this cause came on for a hearing this 31st day of January 1852 before the Honourable Elijah WALKER Judge &c upon the petition of petioners proof in the cause and the report of the Clerk and Master of this Court when it appearing to the satisfaction of the Court that it would greatly impair the value of the tract of land mentioned in the pleadings in this cause to partition the same and that it would be to the interest of the owners that the same should be sold and it further appearing to the satisfaction of the Court that the petitioners have a good legal title to said lands It is therefore ordered adjudged and decreed by the Court that the land mentioend in the pleading Clerk & Master of this Court sell the lands mentioned in the pleadings in this cause at the Court house door in Waynesboro to the highest bidder after having given thirty days notice in writing at three or more public places in Wayne County one of which shall be at the door of the Court house in Waynesboro on a credit of one and two years taking from the purchaser bond and approved security and retaining a lien on said land until the purchase money is paid and that he report to the next term of this all other matters being reserved &c

BREWER and the argument of counsel being closed and the charge of the Court delivered the jurors aforesaid on their oaths aforesaid do say that the defendant is not guilty in manner and form as charged in the Indictment in this behalf It is therefore considered by the Court that the defendant be hereof discharged and go hince without day and that the State of Tennessee pay the costs in this behalf on the part of the State expended and that the same be certified to the Comptroller for allowance
