Will of Isham Browder

WILL OF ISHAM BROWDER, Guilford County, North Carolina
In the name of God, amen: I, Isham Browder, of Guilford County, North Carolina, being of sound mind and perfect memory and knowing that it is ordered for all men to die and having pleased God to bless me with a few worldly good, do given and dispose of them in manner and form following:
Item-I lend to my beloved wife, Talitha Browder, during her natural life, the land and plantation whereon I now live togethr with all my household furinture whatsoever and the following horses to wit: Blower, Lockett, Kitty, Gratis and Dlosey; all my stock of cattle, sheep, hogs and 8 Negroes, to wit: Will Cezar, Jinny, Milly, Andrew, Peter, Betty and Daniel, and their Increase and after their decease or widowhood (her decease or widowhood?) I direct that all my personal estae (not hereafter devise) and its increase to be equally divided amongst and between my living issue.
Item-I give and bequeath to my son Isham Browder the land whereon I now live, containing by estimation 1289 acres, likewise my English horse, Jack (or Jacob) the Bachelor, only deduct 1/3 part of the earning of the said horse in order and maintaining him and collecting the money arising from the said horse covering, which said money I desire to be put to interest under bond sufficient security, so that my said son may receive the same at his arriving to the age of 21 years, to him, his heirs, his assigns forever.
I likewise direct that my wife do school and have my children educated out of the profits of my estate.
I direct that my executors sell on 6 month's credit my Waggon and such of my Team as may not hve been heretofore given and my tract of land purchased of Isham S. Browder containing by calculation 150 acres and that all my jsut debts be paid from the moneys from such sale and that the residue and such moneys that may be due to me (meaning outstanding debt and what may remian from the above said after my just debts are paid) I do give and devise to my beloved wife. Talitha Browder.
Lastly I appoint my beloved wife my executrix and my friend Abrahm Womak in witness I have hereunto set my hand and seal this 27 day of September 1779.
Sealed and delivered in the presence of Isham Browder
I give unto my daughter, Talitha Cox Browder, my grey horse pruchased of JOhn Ballinger and the voidings of the said horse from covering and I desire that my executrix and Executors do maintain the said horse out of the crops by my Negroes, so that it may be clear profit to my said daughter, Talitha her heirs and assigns forever.

To the worshipful the Justices of the Court of Pleas and Quarter Sessions for Rockingham County--
The petition of Clement Whittmore and Martha, his wife, Elizabeth Browder, administrator of Augustus Browder, deceased, also of Milton A. Browder, Isham Browder, JR., Nancy Browder, Augustus Browder, Elizabeth Browder which said Augustus and Elizabeth are minors prefer this their petition by their Mother and next friend and aforesaid Elizabeth Browder, also of Nathaniel Roach and Tabitha his Wife.

Isham Browder, JR.- William Meador administrators of the estate of Nancy Thrasher dec. also against Isaac Clark and Talitha his wife and Augustine Fears.
Humbly sheweth that Isham Browder late of the County of Rockingham departed this life in the spring of 1785 leaving a widow named Talitha Browder and the following children to wit. Isham Browder, Augustus Browder, Mary Browder, Nancy Washington Browder, Talitha Browder and Martha Browder, that the said Mary Browder intermarried with Richard Thrasher and they both died in the year 1792 leaving an only child named Nancy Thrasher, who hath since died and administration of her estate hath been granted to William Meador by this worshipful Court. That the said Nancy Washington Browder intermarried with Cloud Thrasher who having died leaving two children both of whom died minors & without issue. She intermarried with William Fears and the said Nancy and William are both dead, she having died first, leaving an only legitimate child, named Augustus Fears who is an infant. That the said Talitha Browder first married Isaac Thrasher by whom she had three children now (now?) living. He having died, she intermarried with Issac Clark. That the said Augustus Browder hath long since died intestate and administration of his estate was granted by this worshipful court to your petitioner Elizabeth Browder his widow; and he left the following chldren, to wit, your petitioners Milton A. Browder, Talitha Browder, intermarried with Nathaniel Roach, Isham Browder Jr. Nancy browder, Augustus Browder & Elizabeth Browder - And your petitioner Martha hath intermarried with your petitioner Clement Whittmore - Your Petitioners show that the said Isham Browder having died as before mentioned HIs widow took possession of his estate claiming to hold the same for life under a paper writiing which she alleged was the last will and testament of her dead husband bearing the date 27th September 1778 or thereabouts, but what was never proved as such so far forth as your petitioners can ascertain. That she continued to hold and dispose of the said property until her death which happened a short time ago, having all that time in her possession or custody another paper writing duly executed by the said Isham Browder as his last will and testament on or about the 27th day of September 1779 and which after his death she found among his valuable papers and effects and carefully concealed the same from your petitioners who although they had understood during her life time that such paper writing had been found after the said Isham's death, never saw the same nor knew the contents thereof - nor whether the same had been kept or destroyed until the month of April last when the same was discovered among the papers of the said Isham which had been kept and preserved by his said widow.
Your petitioners shew that they have annexed to this their petition the said paper writing and that the same is the last will and Testament of the said Isham Browder decd every part thereof being written in his own proper handwriting and duly signed by him and your petitioners pray that the same may be issue to the said Isham Browder Jr. and William Meador administrators aforesaid, that publication be made in some newspaper designed by your Worships for the said Isaac Clark and Talitha his wife, and the said Augustus Fears who resides out of this state to appear and be made parties defendants to this petion and to show cause if any they have why the said paper writing should not be admitted to probate in this court as the last Will of Isham Browder, deceased - And as the said Augustus Fears is a minor your petitioners pray that your Worships will appoint a guardian pending this petition to defend his interest therein - And your petitioners pray for such other and further relief as their case may require and that the process to be issued in this case may be returnable to the next court of Please and Quarter Sessions to be held for Rockingham county on the fourth Monday of August next.

Will of Wife Telitha

WILL OF TELITHA BROWDER
In the name of God Amen I Telitha Browder of the County of Rockingham do make and ordain this my last will and Testament in the first place I commit my soul to the hands of Almighty God who gave it and my body to the Earth to be buried in a decent manner at the discretion of my Executor as to the property with which it has pleased God to bless me with I disposed of in the following manner.
I will and bequeath to my Daughter Talitha C. Clarke the sum of fifty cents she having married against my will and wishes I will and bequeath to my Daughter Patsey Whittemore my Negro woman Doll and her children - Lewis Isaac & Easter and the future increase of the family female Salves my large family bible two feather beds and furniture together with all my household and kitchen furniture my cart and Steers together with all my stock of Cattle hogs sheep and horses that I may not Otherwise dispose of in this will amd my crop that may be on hand at my death to her and --heirs forever the said Patsey Whittemore having nursed me comforted me in & waited on me in my last days.
I will and bequeath to my Granddaughter Telitha Whittemore the child of my Daughter Patsey Whittemore a little Negro Girl named Darkes the child of Doll to her and her heirs forever but if in the case the said Telitha should die before she arrives of lawful age than in that case I will and bequeath the said Negro Girl Darkes to my Granddaughter Martha Amanda Whittemore to her and her heirs forever and my will and desire is that until the aforesaid children arrives of lawful aget that the said Girl Darkes remain in teh possession of my daughter Patsey Whittemore for her special use.
I will and bequeath to my two grandchildren Augustine B. Fears and Patsey Nolan children of my Daughters Tilitha and Nancy a Negro boy named Cuffy a Negro boy named Joe a Girl named Aggy and her future increase to them and their heirs forever shear and shear alike however the said Augustine B. Fears being a youth and under age if he should die before he marry and have (another "and have" both underlined") children of his own to heir his part of the above mentioned property Cuffey Joe and Aggy and her increase to her and her heirs forever and in order tht this devise may be carried into effect consistent with my wishes I direct that my Executor hereinafter named May Keep in possession till the time and circumstances my occur.
I will and bequeath to my Grand Daughter Nancy Whittemore the Daughter of my Daughter Patsey my saddle and Gun box to her and her heirs forever.
Lastly, I ordain constitute my friend Clement Whittemore and Jno Wall Esq my Executors of this my last will and Testament and hereby revoking all Other wills or will by me heretofore made.
My hand and seal this 29th day December 1827.

He married TALITHA COX February 03, 1767, daughter of JOHN COX and MARY COLEMAN. She was born 1745 in Virginia, and died in Rockingham Co., NC in 1828. He did NOT marry anyone named Martha!
