Noble K. Gunn was the complaining witness who received the money. The respondent was recognized to appear and informed against mainly on the testimony of this Complaining witness.

After the cause had been in Court several terms, made considerable cost for the People and was ready for trial at this term, with witnesses in attendance, Noble K. Gunn informed the Prosecuting Attorney that he had forgotten in his complaint and testimony before the magistrate to state a very material point, viz.: that Burrel G. Gunn when he gave him the counterfeit money, gave him to understand that it might not be good, as he had before made several ineffectual attempts to get rid of it, and that he (Noble K.) must take it at his own risk. This information, of course, made it necessary for the Prosecuting Attorney to enter a nolle prosegui. The Court ordered the complaining witness to pay the People's costs and in default thereof that an execution issue for their collection."
