That Benjamin Melvin died sometime between 23 Jul 1740 when he enlisted for the Spanish War and 6 July 1748 when the distribution of his brother David's estate notes a description of land "bounded northwardly on Land Belonging to the Heirs of Benjamin Melven Dec'd." Therefore these two men are not identical.
