Deed, 5 Jan 1838 Gilbert Gay to Amos Gay (Oswego County Deeds, Vol. 28, p. 25): Twp 6, Lots no. 120 & 134 25, 80 - 10 acres $300.00 THIS INDENTURE... [5th January, 1838] Between Gilbert Gay of the Town of Amboy... and Amos Gay of the same place... in consideration of... $300.00... ALL of that certain piece of land... in Township Six... Town of Amboy and being part of Lot 120... Also the north half of Lot 134 in said Township... containing 80 acres... excepting 10 acres off of the westerly end of said northerly half... Census 1840, Amboy, Oswego County, NY: Gay, Amos : 2 males ages 20-29 1 female age 20-29, 1 female age 40-49 PROBABLY THESE WERE BROTHER GILBERT + SISTER MARY + MOTHER LUCY County of Oswego Surrogates Court In the matter of administration on the estate of Gilbert Gay, deceased: To the honorable Orla H. Whitney Esq., County Judge & Surrogate of said County-The petition of Amos Gay of the Town of Verona, Oneida County and State of New York respectfully sworn… That your petitioner is the elder brother of the late Gilbert Gay deceased and as such is rightfully entitled to letters of administration on the estate of the said deceased. And whereas letters of administration has been granted by you as it is said on the application a copy of which is hereunto annexed, to Mary D. Gay of Amboy in said county. And I, your petitioner, further says that the said Mary D. Gay, so called, emending to the best information and belief of our petitioner is not the widow of the late Gilbert Gay. And your petitioner further says that he was well acquainted with the late Gilbert Gay since March 1844 and that his residence from that time to the time of his decease was in the Town of Verona, Oneida County and State of New York. Now therefore your petitioner prays that the said letters of administration granted to the said Mary D. Gay aforesaid I may be by you revoked on the ground of fake allegations and representations by the said Mary D. Gay in the said application. And your petitioner will ever pray ?? William Feindley, Atty Amos [his X mark] Gay State of New York, Oswego County Amos Gay of the Town of Verona, Oneida County and State of New York being duly sworn says that the facts and circumstances as set forth in the foregoing petition are in all respects true. Amos [his X mark] Gay In matter of the application of Amos Gay to vacate the letters of administration to Mary Gay of Gilbert Gay, deceased: August 26, 1848, O.H. Whitney, Co. Judge Objected that Amos was an incompetent witness. Testimony Amos Gay-I was acquaint? With the deceased; I am brother to him; he was older than I am; he had no brother other than I am; I have a demand of $15 or $20 against the estate that was for lumber to build a boat. It has not been paid. The ??? ??? together he owes me $15 or $20 . The father & mother of the deceased is dead admitted? --- ??? built for himself newer? A canal boat we built one ??? never settled he let me have some change, I cannot see how we stand. I let him have $150 the first time & $130 the last time for replace; I bought of him after he convey ??? to me, we never had a settlement; he let me have $18 in cash at one him last ?? I paid him $18 when I took off the wood. I think he ??? himself towards the boat ; he said not furnish $50 ??? nor $25 new. I am the ??? two ??? I let a man have the boat to go to ??? from Durham Me? I went to Utica twice with $100 in any would take 3 days. I could go two trips in a week. I know he was ??? to me when he ??? Samuel Breese, Sidney I. Breese & Nathan F. Graves, executor of S. Sidney Breese deceased... and Amos Gay of Verona... [$800.00]... situate in the Town of Verona... being the easterly part or subdivision of Lot number [87] of the late Oneida reservation... containing 83 1/3 acres... being the same premises now occupied by said John Gay... Recorded July 8th, 1851 Deed, 30 April 1851, Amos & Mary Gay to John Porter (Herkimer [!] County Deeds, vol. 159, p. 69): ... Amos Gay of the Town of Verona... and Mary Gay his wife... and John F. Porter of the same place... [$630.00]... situate ... in the Town of Rome... commencing on the easterly side of Lot 87... containing 35 acres... Recorded June 28, 1857 Deed, 6 June 1853, John Jones to John Porter (Herkimer [!] County Deeds, vol. 175, p. 22): ... John R. Jones, late Sheriff of the County of Oneida... and John F. Porter of Higginsville in [Town of] Verona... Whereas by virtue of a certain execution issued out of the County Court of the County of Oneida at the suit of Elisha Morse and Joshua Morse against Amos Gay, defendant... that the goods and chattels... should cause to be made certain moneys..., and if sufficient goods and chattels could not be found that then he should cause the amount so specified to be made of the real estate... and the said John R. Jones Sheriff... did levy on and seize all the estate... conveyed on the [5th] day of March [1852], sold the said premises at public venue... at which sale the said premises were struck off to Elisha Morse for the sum of [$180.00]... and whereas the said premises on the [11th] February 1853... were redeemed by John F. Porter... grantee of said premises by Warrantee Deed made by the said Amos Gay before the said sale... All that certain piece of land situate in the Town of Verona... it being the easterly part of Subdivision of Lot No. [87] of the late Oneida Reservation... containing 83 1/3 acres... Recorded June 13, 1853 Oswego County Mortgage, 21 Nov 1850 Amos Gay to Mary Gay & Seth Burton Vol. 29, p. 379 Twp 6, lots 120 & 134, 25, 80 acres - 10 acres $275.00 Oswego Daily Journal, March 1854: MORTGAGE SALE Whereas Amos Gay executed to Mary D. Gay and Seth Button a certain mortgage of real estate dated, executed November 21st, 1850, and which said mortgage with a power of sale therein contained was duly recorded in the office of the clerk of Oswego County on the 23d day of November 1850... in book No. 29 of mortgages, pages 379 and 380, on which said mortgage there is claimed to be due on the day of the first publication of the notice the sum of $111.29 and there ... become due the further sum of $183.31 with interest... The mortgaged premises are described... as follows... Scriba's Patent in the town of Amboy, Oswego County and being part of lot 120 and bounded as follows... and whereas also the interest of said Seth Button in said mortgage has been duly assigned to James Krombee and default has been made in the payment... now therefore notice is hereby given that by virtue of the power of ... in said mortgage.... the said mortgaged premises will be sold at public auction at Gasper's Hotel in the Village of Fulton... on the 3d day of March A.D. 1854 SHERIFF SALE By virtue of an execution issued out of the Supreme Court of the State of New York, against the property of Amos Gay, I have seized and taken all the right, title and interest which the said Amos Gay had on the 8th day of September 1851 or which he may have since acquired of in and to the following described premises, situated in the Town of Amboy, County of Oswego... to wit: All that certain piece or parcel of land situate in the Town of Amboy... being part of lot no. 120 and bounded as follows... being the same premises described in a Mortgage given to Amos Gay and wife to Mary D. Gay and Seth Burton and recorded in Oswego Co. Clerks Office in Book of Mortgages no. 29 on Pages 379 and 380, which said premises I shall expose for sale at public auction at the Welland House in the city of Oswego on Thursday the 23d day of March next... Dated, Oswego, Feb'y 1854.
