    The Last Will and Testament of Abraham Shaefer
    of Reeder Township Anderson County and State of Kansas.

    Be it remembered by all whomsoever it may concern that I the undersigned Abraham Shaefer of Reeder Township Anderson County and State of Kansas, fully believing in the existence of our all wise and ever present God, and being admonished by my somewhat advanced age and my bodily infirmities that my time on earth cannot at most be many years, do hereby will and bequeath all my real estate and personal property to the several members of my family herein named in the following manner, viz:

    Article 1st: I hereby appoint my three Sons, Samuel W. Shaefer, Francis M. Shaefer and Otis O. Shaefer my Executors, and empower Said Executors to set[?] and do all necessary in the settlement of my estate with being required to give Security other than their own individual bond.

    Article 2nd: That they pay all my honest and just debts.

    Article 3rd: That my executors See__n[?] payment to my wife Catherine Shaefer interest at 10 p[er] c[en]t per annum (said interest to be paid to her annually on all money due me at the time of my death after paying all my just debts), also Said executors are required to pay my Said wife Catherine one half the income from 32 acres of land I own in Ohio known as my Peach Orchard until Said Peach Orchard is Sold then interest at 10 p[er] c[en]t per annum on the whole amount of proceeds arising from such Sale and money due now to my estate, after paying my just debts during her life time, all Said interest to be paid annually.

    Article 4th: My Executors shall have full power to collect all demands due me and pay from the proceeds any just debts against me.

    Article 5th: My Executors shall have full power to use any money arising from the Settlement of my estate each of Said executors to have the use of one third part of Said money by first Securing payment at 10 p[er] c[en]t per annum to my wife Catherine, said interest to be paid annually.

    Article 6th: I will my horses, cattle, hogs, and all my farming utensils to my two sons Francis M. and Otis O. Shaefer, to be divided by themselves without any other person interfering in any way or manner whatever.

    Article 7th: I give and bequeath to Lucy Adel Bowman My Granddaughter when she arrives at the age of twenty one years the principle of the money arising from the sale of the 32 acres of land owned by me in the State of Ohio known as my Peach Orchard the interest of Said money to be paid to my wife Catherine until Said Lucy is twenty one years of age, provided my wife [lives?] until Lucy is 21 years of age, in case of my wife's death the interest of the proceeds of Said Peach Orchard to be divided between my three sons Samuel M., Francis M. and Otis O. Shaefer, until Said Lucy arrives at the age of twenty one years, then the principle to be paid to the Said Lucy Adel Bowman.

    Article 8th: I hereby give my Son Francis M. Shaefer by himself alone full power after my death at any time to sell the 32 acres of Land I own in the State of Ohio and apply the proceeds directed in Article 7 of this instrument without his being required to give Security other than his own individual bond for the performance of any duty I hereby impose on him. I also will that in case any of Lucy Adel Bowman's relations or friends or any other person or persons in Said Lucy's interest shall in any way interfere with my Son Francis M. Shaefer in the performance of the duty, I hereby impose upon him that Said Lucy Adel Bowman Shall be forever barred from all legal claims to any part of Said proceeds and Said money to be divided equally after paying any costs in the matter between my three Sons Samuel M., Francis M. and Otis O. Shaefer.

    Article 9th: I give and bequeath to my two Sons Francis M. Shaefer and Otis O. Shaefer each an undivided half of the following described land, to wit: So much of the North half of the North East quarter of the South East quarter of Section Twenty two (22) Township Twenty (20) in Range Nineteen (19) as lies on the east side of Cedar Creek, containing fourteen (14) acres more or less.

    Article 10th: I give and bequeath to my Son Samuel Shaefer five acres of timber land which is a part of the North East quarter of Sec. 12 Township 21 Range 17, it being the timber land I bought of Lewis Beilor.

    Article 11th: All former wills are hereby made null and void. Given under my hand and Seal in the township of Reeder county of Anderson and State of Kansas this 4th day of February AD 1877.

    Testimony of M. Porter

    Matthew Porter being duly sworn on oath says that he is one of the Subscribing witnesses to the instrument in writing purporting to be the last will and testament of Abraham Shaefer of Anderson County, Kansas, now here presented for Probate, that on the day of the date of Said instrument to wit: the 4th da of February AD 1877, at the residence of the Said Abraham Shaefer, the Said instrument was Signed by the Said Abraham Shaefer, that the Said Abraham Shaefer then and there acknowledged, published and declared Said instrument as and for his last will and testament in the presence of deponent and of D. S. Altman the other Subscribing witness, and that deponent and the Said D. S. Altman did then and there in the presence of the Said Abraham Shaefer and at his request Severally Subscribe Said instrument as witnesses thereto and Deponent further says that at the time of the execution of Said instrument as aforesaid, the Said Abraham Shaefer was of full age, of Sound mind, memory and understanding and under no restraint to the best of Deponent's knowledge, and as he verily believes, and further Deponent Sayeth not.
