Death and Probate

In his will dated 25 January 1851,[3][5] Aaron Writer of the town of Mount Hope, Orange co., New York, bequeathed to his four sons, Jasper A. Writer, Mathew M. Writer, Aaron K. Writer, and John F. Writer, an equal share of his farm “whereon I formerly lived and where my sons Mathew and John F. Writer now live,” containing 167 acres, one road, and ten rods of land. He stated that his sons Isaac V. Writer and Benjamin N. Writer were previously given their share of property in an article of agreement entered into in late 1850 or early 1851 (and held by Stephen C. Writer). He bequeathed $100 apiece to his four daughters then living, Eve wife of Daniel Huff, Jane wife of Benjamin Shay, Eleanor wife of Cornelius Van Allen, and Elizabeth wife of William Allen. He also bequeathed $100 for each of his deceased daughters, Catharine Vandermark, Jemima Depew, and Margaret Van Tuyle, with the money to be divided equally among her children. His personal property was to be sold at public auction. The resulting surplus or debt was to be shared equally by the four first named sons. His son John F. Writer was appointed executor. Aaron dictated his will to David Hulse, who along with John K. Davis served as witnesses.

On 11 July 1855,[3] John F. Writer petitioned the Surrogate's court of Orange co., and citations were issued. The will was proved in court by both witnesses on 4 September 1855,[3][4][5] and John F. Writer was appointed administrator. On 29 June 1857,[6][7] John signed a petition for the Surrogate to issue a citation for final settlement of accounts, which he did on 1 July. The final decree was given in court on 26 October 1857.[6][7]
