"In the name of God Amen the 2nd Day of August Ana Domino 1776, I James Huston of the county of Rowan in North Carolinas being in perfect health and soundness of memory thanks be to God for his mercies and calling to Remembrance the uncertain Estate of this transitory life and that all flesh must yield to Death when it shall please God to call, Do make constitute ordain and Declare this my last will and testament in manner and form following Revoking and annulling by these presents all and every will or testament heretofore by me made either in word or writing and this to be taken only for my last will and testament and none other and profess my penitence and sorry for my sins past committed against a kind and merciful God now humbly desiring forgiveness for the same. I give and commit my Soul unto Almighty God my Savoir and Redeemer in whence and By the Merits of Jesus Christ. I trust and believe assuredly to be saved and that my Soul with my Body at a general Day of Resurrection shall arise again with Joy and through the merits of Christ’s Death and passion possess and inherit the Kingdom of Heaven prepared for his elect and chosen and my Body to be buried in such a place as my friends or Christian Brethren shall think fit. And now for the Settling of my temporal Estates and such goods, chattels and debts as it hath pleased God far above my Deserts to bestow upon me. I do order, give and dispose the same in manner and form following: that is to say first I will that all those debts and dues as I owe in right of conscience to any manner of person or persons whatsoever shall be well and truly contented and paid or ordained to be paid within convenient time after my decease by my Executers hereafter named.
Item: I give and bequeath unto my oldest Brother Samuel Huston all my right title or interest in the tract of land he now lives upon with all the horn cattle I have at his place and at the Coopers and my Black horse -

All which articles be thee said Samuel Huston is to have and to hold until his son James is twenty-one years of age when he the said Samuel Huston shall pay unto his son James forty pounds proclamation money in lieu of the land before mentioned
and unto Brother Samuel’s oldest son Peter Huston I give and bequeath my silver shoe and hose buckles with all my clothing now at Brother Samuel’s except my cloak and my best saddle and bridle -
and unto Martha Huston, oldest daughter of my Brother Samuel I give and bequeath the sorrel mare which I bought from William Sharp now in the yard of Patrick Porter upon Clinch -
and unto my father Robert Huston I give and bequeath my cloak and the bond upon Brother Robert which was assigned over unto him.
I will and bequeath unto my Brother Robert Huston all the horn cattle pertaining unto me which are in his possession with my plow and tacking there unto belonging any of that clothing I left at Robert Edmistons’ with what corn I made last year and what is coming me from Robert Edmistons’ harvests to be paid in hay -
I give and bequeath unto Brother Roberts two sons now born vis. unto Robert his oldest son that claim of land I bought from John Lowrey lying between Robert Lowrey’s and that which I have of Robert Edmiston’s
and unto James his second son I give and bequeath that claim of land on which my cabin is built which formerly belonged to Robert Edmiston.
I give and bequeath unto Brother Christopher Huston my negro boy Jamie and my ranch horse or what may be got for him to have and to hold until his sons that are now born shall arrive at the age of twenty-one years when he the said Christopher or his Executers shall pay unto each of them at that age thirty pounds thus currency -
I will and bequeath unto Brother Christopher’s oldest daughter Martha my white mare now at Clench [1] and if she has any colt which falls to me it is to be Martha’s and if not, she is to have the mare alone.
I will and bequeath to my sister Rebecca Edmond fifty pounds proclamation money to be paid out of the money owing to me as soon after my decease as it can be conveniently collected which money she the said Rebecca is to have and to hold during life and then to descend unto her son James Edmond and her daughter Martha -
And the said fifty pounds left- "at my sister Rebecca Edmond’s decease" shall be equally divided between-"her son James and her daughter Martha before mentioned -
