Regarding will of Wm. Sutton: No. 505 "In the matter of the estate of William Sutton, deceased. In Probate Court Williamson County, Texas. ________, Judge said court. Your petitioner alleges that since he was appointed administrator of the estate of William Sutton, deceased, he has learned that said William Sutton did not die intestate as he formerly believed, but at his death left his last will and testament duly executed in accordance with law--That affiant is unable to give the date of said will, but he believes the same was enacted in the latter part of the year AD 1886. Affiant is informed, so he believes and therefore alleges that___Robinson and___Wood were the subscribing witnesses to said will. That both of said witnesses reside in Wm. County, Texas, that said Robinson is a practicing lawyer and as such wrote said will for said Sutton. Affiant further states that though said will aforesaid bequeathed all of the property of the said Sutton to all of his children, that the affiant has not been able as yet to see said subscribing witnesses to said will, and he is therefore unable to state the further contents of said will, but that when said will is offered for probate said witnesses will be present, and by affiant will fully prove the contents of the same. Affiant further says that he is unable to produce said will because he says he has been informed, and believes the information to be true, that S.A.V. Sutton, the last wife, and now the widow of said William Sutton deceased, destroyed said will subsequent to the death of said William Sutton. That by said will Isaac Sutton, who lives in Williamson County, Texas, and who is a son of said William Sutton, was appointed executor of said will. That the following are the heirs at law of said William Sutton, deceased: Reubin Sutton, who lives at Parsons in the State of Kansas. Daniel Sutton, Sandusky, Ohio. Isaac Sutton, Williamson County, Texas. William Sutton, Rulo, Nebraska. David Sutton, residence unknown. Moses Sutton, Rulo, Nebraska. Jarilla Sutton Bauman, Rulo, Neb., Mary J. Morehead, Ken Kizo ? Ind., Phillip Sutton, residence unknown. That the above are all the heirs that affiant knows of. Affiant further makes as a part of this application, his petition for the appointment of letters of administration. Promises considered, this affiant prays that all proper citations and process be issued as required by law. That said will of said William Sutton, deceased, be probated and that Isaac Sutton be appointed executor in accordance with said will. That in the meantime, no further action be taken in the administration now pending, and that when said will shall be probated that the letters heretofore issued to this affiant be revoked and cancelled. Sworn to and subscribed before me this 8th day of June AD 1889.
