The will of Samuel Hannon

Memorial to be registered of an indenture in the words and figures following;------

This indenture made the second day of February in the year of our Lord one thousand eight hundred and fifty nine between Samuel Hannon of Glanford in the County of Wentworth, Yeoman, of the one part and Joseph Hannon of Glanford aforesaid, Esquire of the other part Witnesseth as follows;----

In pursuance of an agreement this day entered into and for certain good considerations the Said Samuel Hannon assigns to the said Joseph Hannon his executors and assigns all monies secured by two indentures of mortgage of even date herewith and respectively made between Joseph Hannon therein described of the one part and the said Samuel Hannon of the other part and Hugh Hannon therein described of the one part and the said Samuel Hannon of the other part for securing respectively the sums of four thousand and twenty five dollars without interest as in said Mortgages respectively mentioned with power for the said Joseph Hannon his executors, administrators and assigns or his or their substitutes in the name of said Samuel Hannon to sue for, receive and give receipts for the same monies so secured by the said respective mortgages upon Trust out of the money secured by the mortgage of the said Joseph Hannon to pay as follows;---

To the said Samuel Hannon his executers, administrators or assigns the sum of eleven hundred and seventy five dollars without interest. That is to say Fifty dollars per year for the first five years and one hundred dollars a year for each and every year afterwards until it shall have been paid except the last year when the balance or sum of twenty five dollars shall be paid to William Hannon of the Township of Camden in the County of Kent, farmer.

Two hundred dollars to Bathsheba Hannon, Abraham Hannon and Catherine Hannon infant children of the late Samuel Hannon of Glanford in the County of Wentworth aforesaid, deceased, the sum of seventy five dollars each.

To John Y Hannon of Glanford aforesaid, farmer, five hundred dollars.

To Charles Hannon of the same place, farmer, one thousand five hundred dollars and to Elizabeth McCall of Lee County State of Illinios, one of the United States of America fifteen hundred dollars.

And upon trust out of the money secured by the Mortgage of the said Hugh Hannon to pay as follows- that is to say-

To the said Samuel Hannon his executors administrators or assigns the sum of eleven hundred and twenty five dollars without interest at the times and in the manner mentioned for payment of the said Samuel Hannon out of the Mortgage of the said Joseph Hannon. Except for the last year when seventy five dollars are to be paid to Henry Hannon of Lee County-Illinios aforesaid,-to Margaret Long wife of James Long of Lee County aforesaid-to Nancy Hannon wife of Henry Hannon of Camden aforesaid fourteen hundred dollars.

To Harriet Hannon infant daughter of Samuel Hannon of Glanford aforesaid seventeen hundred dollars-The gift to the said minors to be paid on their respectively attaining the age of twenty one or so soon after as the said Trustee shall be in a position to pay the same. The other gifts to be paid when the same shall have been realized out of the mortgages.-The said Trustee his Executors, administrators and assigns shall have the uncontrolled discretion of applying the receipts from the said Mortgages to the payment of such the Donees by way of priority as he shall think proper and expedient. The said Trustee may raise and apply for any minors benefit his or her interest under this trust, payment to a guardian being deemed such an application. The Trustees receipt shall discharge persons from paying purchase or other money from liability to the application thereof. -

The said Joseph Hannon his executors or administrators may appoint one or more persons in their place with the powers of the said original or future Trustee, who shall die, be abroad or refuse to become incapable to act and every refusing Trustee shall be deemed continuing for the purpose of supplying his own or any other then subsisting vacancy.---

The said Samuel Hannon grants unto the same Joseph Hannon and his heir and assigns the premises comprised in the said two mortgages from the said Joseph Hannon and the said Hugh Hannon and described in the schedule hereto with their usual legal appurtenances, but subject to the equity or redemption subsisting by virtue thereof and subject to the trust herein contained..

In witness whereof the parties hereto have set their hands and seals the day and year first above written.
