Early Land Acquisition in Orange County, VA

  • Pages 436-39. 23 Sept. 1743. Philemon Hawkins and Sarah Hawkins his wife of St. George's Parish, Spotsylvania County, to Stephen Smith als. Noblet of St. Thomas' Parish, Orange County. For £50 current money. 500 acres, part of a patent to Samuel Smith 28 Sept. 1728 and by Samll. Smith given unto said Stephen Smith (his son) by his last will and testament together with other things which will divided the estate of Samll. amongst his children and the will being given into the care of Stephen I K Smith from whom the will was stolen and destroyed, which occasions the estate of Samll. Smith, he being now deceased, and Sarah the only child that survives him the said Samuel that was born in wedlock... in Mr. Tayloe's line near a lucust thicket... Richard Thomas's...   • Indenture 22 Sept 1743 between Phillimon Hawkins and Sarah, his wife, of County of Spotsylvania, St. George's Parish and George Smith, alias Noblet, Parish of St. Thomas, Orange County... for sum of £30.. for 400 acres.. part of patent granted Joseph Hawkins, and by Joseph Hawkins granted to Edward rouse, by the saide Rouse sold to Samuel Smith, and by Samuel given his bond hearing date the 23rd day fo Jany 1732, and also given by the sd. Samuel to George, his son, by his last will and testament, which will divided the estate of Samuel amongst his children.. And the will being given unto the care of Stephen I. K. Smith, from whom the said will was stolen and destroyed.. which occasioned the said Phillimon Hawkins, and Sarah, his wife, to have the right to all the estate of Samuel Smith, being deceased, and Sarah, the only child that survived him that was born in wedlock.. land bounded as followeth: North Fork Northanna.. consists of one third part of Samuel Smith, dec'd, estate, the other land excepted, of all now in actual possession of George Smith, alias Noblet.. included negroes, horses, cattle, hoggs, beds and other household goods. . . . Smith, from whom it was stolen and destroyed.. which occasioned Phillimon Hawkins and Sarah his wife, to have right to all the estate of Samuel, he being dec'd, and Sarah, the only child that survived him born in wedlock.. one third part of Samuel Smith's estate.. now in the possession of Charles Smith, alias Loblet. . . . Peaceable possession delivered by the within named Phillmon Hawkins and Sarah, his wife, to Charles Smith 20th day of Sept 1743. Phillimon and Sarah Hawkins acknowledged this deed to Charles Smith, alias Noblet.

Spts Co. to Joseph Hawkins of sd Par. and county. 5 pounds curr. 200 a. on both sides of Terry's Run in Co and Par afsd, left by the last will of John Hawkins decd. to be divided between Mary, his wife, and four of his children Elizabeth Smith, Philemon Hawkins, Phebe Smith, and the sd. Mary Cragg. Witnesses, A. Foster, Edmund Foster, Larkin Johnston. April 7, 1747. (Note: record helps to prove parentage of this Philemon Hawkins).

Philemon Hawkins probably came from Spotsylvania County, Virginia, for on November 16, 1742, Joseph Hawkins, son and heir of John Hawkins, late of Spots., made a deed to his brother Philemon Hawkins of said County. Joseph stated that the last will of John Hawkins was recorded in King William. He mentions his mother, Mary Hawkins, George Smith and Elizabeth, his wife, and Phoebe Hawkins. This family probably connects with Hawkins of Spots. and Orange (I T 255) Capt. Thomas Hawkins (d. 1677) was Burgess from Warwick, and John Hawkins (d. 1726) was Burgess from Essex.
