Will Transcript

1, Moses ATKINS of Giles Co and State of Virginia, being of very weak in body but perfect in mind and memory, thanks be to God for his mercies, I do make, constitute and ordain this my last will. First of all I recommend my soul to God who save it and my body to the earth from which it came to be decently buried in Christian like manner and as for my worldly goods that it hath pleased God to help me with, I do dispose of in manner and to front of all swire to wit.
First I give and bequeath unto my wife, Mary ATKINS my home plantation where I now reside, houses and kitchen and all that belongs in the house where I now dwell and the kitchen furniture and two black boys, Ned and Lewis and one Mullatter Girl named Emmaline, four head of horses, one sorrel mare about six years old, one sorrel horse Jack, one sorrel horse Davy, one boy horse Charley, four milk cows choice of the flock and twenty head of choice hogs and also my patton plow and two shovel plows and the gearing to farm horses and waggon, two double trees, one pair of stretchers fifth chains and all the gold and silver that I have in my possession. Mary my wife is to give each of my daughters, Susannah, Elizabeth and Rachel one cow and one calf each as the worth of them when married and one bed and furniture equal to those that have married and each of the boys the same when married and also Susannah my daughter is to live with my wife so long as my wife lives if she be pleased to do so or if she continues single.
Secondly I give and bequeath to my eldest son Hiriam the place where he now lives o n if his legacy in my estate of land amounts to one thousand dollars when all my estate of land is finally settled if my lands is not sufficient to make all my sons one thousand ? those that gets the land to that amount shall pay those that do not get that amount in land make all my sons equal and all my land is to be released if they cannot agree within themselves and each of my sons is to take the land at its valuation and
Thirdly I give and bequeath to my son Enoch and Lewis each to have one fourty dollar horse after the death of my wife or the value,
Fourthly I give to my so n John one black horse called Nigger.
Fifthly, I give to my son William one two year old mare filly.
Sixthly I give to my son Moses one sorrel mare that he bought of VAUGHT and one rifle gun.
Seventh, I give to my daughter Susannah three hundred and fifty dollars in money, also I give and bequeath Elizabeth three hundred and fifty dollars in money, also I give and bequeath Rachel three hundred and fifty dollars in money, all the rest of my estate real and personally of whats nature or kind it may be not herein after mentioned as disposed of. I desire that of the sale and the money issues therefrom to be equally divided between Hiriam, Enoch, Moses, Lewis, Joseph, John, William, Susannah, Nancy, Elizabeth, and Rachel as above mentioned.
Lastly I do hereby constitute, appoint my son Hiriam and son Moses my trusty friends my executors of this my last will and testament with full power to convey and make sufficient rights to all the lands that I have given this my last will.
In witness where of I have here unto set my hand and affixed my seal this 15 day of January 1839.
