There are SEVERAL Internet Trees of this John Hornback with ERRONEOUS and INCORRECT information. Records PROVE that this John Hornback, Sr. married 1st, Elizabeth Phebus 1791 in Bourbon County, Kentucky and she was the mother of ALL of his children. After Elizabeth's death in 1808, he re-married to Jane Campbell, "widow" of James Campbell on 4 August 1811 in Pickaway County, Ohio. There is a Court Case [listed below] claiming that Jane's husband James Campbell was STILL ALIVE when she married John Hornback, but the Court still ruled that Jane was entitled to her dower plus court costs from her marriage to John Hornback. Jane ____ Campbell had two sons from her first marriage to James Campbell, James and William Campbell, both of which were listed in the will of John Hornback which he wrote in 1823.
Will Transcript
- March 12th 1823. I John Hornback of Champaign County and State of Ohio and citizen of Harrison Township, do make and ordain this instrument that is written to be my last Will and Testament, revoking all others. That is after my lawful debts are paid, leave to my wife Jane Hornback one Sorrell mare saddle and bridle.
- Likewise to Elizabeth Hopkins and Doly Core (s/b Kerr) Seventy five dollars Each.
- John, James and Abraham Hornback to have the waggon.
- James Hornback to have the Shop tools, and beq.? pair of yelow irons, and Stretchers and hand gears of the waggon.
- Abraham Hornback one pair of plow irons and Stretchers and fore gears of the waggon and the rock Horse.
- Simon Hornback one two year old grey Coult [Colt].
- John Hornback one house bible.
- George Hornback to have four hundred dollars out of a note on John Walls of five hundred and forty dollars and twenty five cents given the Twenty fifty day of June 1817, and the ballance of said note.
- Also a note on John Wall of ninety dollars dated December the 14th 1818 to be equally devided between my children.
- William and James Campbell to have a note on Samuel Hopkins of two hundred and fifty dollars to be equally devided between them provided they give me or mine a receipt against all debts dues and demands, if they will not the said note to be devided between my children.
- So I conclude my last will and Testament by leaving Daniel Deerdorff and James Car my administrators and Executors to see to and manage my Estate.

- [HI32877] (Research): Champaign County, OH, Record Book 8, Page 467 - Filed 4 June 1824 - Petition for Dower Jane Hornback, widow of John Hornback Vs James Hornback, John Hornback, Abraham Hornback and Simeon Hornback. John Hornback died in February 1824 seized of the west half of Section 8 Township 4 Range 13 (Harrison Tp.), however, the patent was in the name of the son, James Hornback. John left all of his estate to his children, except a trifle which was left to his wife. John and Jane were married about 13 years ago (1811) in Pickaway County. Both had children by former mates, but no children were born to John and Jane. Jane had $500 which went to John on their marriage and John used this money to purchase the land. He paid the first payment and got a certificate, the second payment he paid through John Wall, the third payment through John Vaughn and the fourth through his son, James Hornback. George Hornback, a remaining son, was given $400. The defendants say that the father was married to Jane, but not legally as her husband, James Campbell, was still living when they were married and that Jane began living with John Hornback in Kentucky when James left. They claim that John purchased the land but sold it to James at least two years before he died. The court decreed that Jane was entitled to the dower plus the value of $53 which was rents due since the death of John Hornback. The money was to be paid with sixty days and all parties were to pay the costs of $50.70. Rootsweb.com
