- Frederick Fishbacks Will
- In the Name of God Amen I Frederick Fishback of the County of Culpeper & Colony of Virginia being of perfect sense & memory & Duly Weighing the uncertainty of human affairs, do make & Ordain this my last Will & Testament in manner following. Imprimis I give my Immortal part of the Divine author of my Body to the Earth to be inter'd in such decent sort as my Executors hereafter named shall think proper ~
- Secondly I Lend to be beloved Wife Eve Fishback owing during her live One Hundred & thirty Eight Acres of Land including the house where I now live & Bounded as appears in the plott of my Land, Lott Number three, Also two Negroes named William & Milly. Also my Waggon & two Horses & One Bed & Furniture, One Cow & Calf, One Dish & Bason & four pewter plates, and after her Death it is my Desire that it may be divided Equally Amongst the whole of my children now Living or their Representatives, Except the Land which I give to my son Martin Fishback & his Heirs forever
- Thirdly I give & bequeath unto my Grand children the children of my Daughter Ann Elizabeth Smith Dec'd, One Negro Woman Named Jean to be equally divided her & her Increase amongst them & they to have no more of my Estate.
- Fourthly I give and bequeath unto my Son John Fishback, his Heirs & Assigns forever. The whole of the property which he has now in his possession which I gave him out previous to this date ~
- Fifthly I give and bequeath unto my Son Jacob Fishback his Heirs & Assigns forever all that part of my Estate which he now has in possession
- Sixthly I give & bequeath unto my Daughter Elizabeth Spelman her Heirs & Assigns forever all that part of my Estate which she has now in her possession
- Seventhly I give & bequeath unto my Daughter Catharine Atwood all that part of my Estate which she has Already now in her possession ~
- Eightly I give and bequeath unto my Daughter Sarah Button that part of my Este [Estate] which she has now in her possession which I give to her & her Heirs & Assigns forever ~
- Ninthly I give and Bequeath Mary Fishback One Negro Woman named Sall and her Increase, One Negro boy named Stephen, One bed & Furniture, One Desk & Bason, & four pewter plates & One Mare a Sorrel Colour Named Flour & One Cow & Calf, One Sow & piggs & two Sheep, which I give to here & her Heirs forever ~
- Tenthly I give & Bequeath unto my Son Frederick Fishback & his Heirs forever apart of My Tract of Land whereon I live Bounded as appears in the plott No. (1) Containing Two Hundred & Six Acres being at the South End of my Tract. Also one Negro Boy called little William, & one Negro boy Moses, also One Horse, One Cow & Calf, One Sow & piggs & two Sheep, & one Bed & Furniture, one Dish and Bacon & four pewter plates ~
- Eleventh I give & Bequeath unto my Son Martin Fishback & to his Heirs forever all the Remainder of my Tract which I have not already dispos'd of as also that One Hundred and Thirty eight Acres of Land which is Lent to his Mother, after her Death, as mentioned above. Also One Negro boy Tony & One Negro boy named Harry, One Bed & furniture, One Cow & Calf, One Sow 7 piggs & Stone Colt & two Sheep, One Dish and Bason & four pewter plates ~
- Twelfth after my just Debts is paid it is my Desire that the Remainder of my Estate be Equally divided amongst all my Children then Living & if any of my said Children should die, without a Lawful Child, it is my desire that his, her or their part be Equally divided amongst the survivors of & their Representatives.
- Lastly I do ordain & appoint my sons John Fishback & Jacob Fishback Executors to this my last Will & Testament hereby Revoking all Wills my me heretofore made. In Testimony whereof I have hereunto set my hand & Seal this twenteeth day of September one Thousand Seven hundred & Eighty two.

- This last Will and Testament of Frederick Fishback Dec'd was Exhibited to the Court by John Fishback and Jacob Fishback the Executors therein named, and was proved by the oaths of Joseph Coons Junr., Joseph Coones, John Wigginton Witnesses thereto and ordered to be Recorded and on the Motion of the said Executors Certificate is Granted them for Obtaining a probate thereof in due form they having made Oath thereto and Given Bond and Security According to Law.
