    In the name of God Amen, The five & Twentieth Day of January in the yeare of our Lord 1638. and in the fowerteenth yeere of the Raigne of our Soveraigne Lord Charles by the grace of God of England Scotland France & Ireland King Defender of the faith etc I Sir John Byne of Rowdell in the parish of Washington in the County of Sussex knight being sensible of my mortalitie & being Diseased in my body but of sound & perfect memory thanks be given to Almighty God therefore Doe make and ordayne this my last will & Testament in manner & forme following First & principally, I bequeath my soule into the hands of Almighty God my Creator Trustinge assuredly by the passion meritts & [...] of my blessed Savior Jesus Christ to have full & perfect remission of all my synnes And my body I comitt to the earth to be buryed in the Chancell of the parish Church of Washington aforesaid And concerninge that worldly estate wherewith it hath pleased God to blesse mee I dispose of it in manner followinge And first I appoint Consitute make ordeyne & declare my eldest son & heire Edmund Byne to be my whoe & sole Executor of this my last will & Testament Item I give & bequeath unto the Cathedral Church of Chichester Twenty shillings Item I give & bequeath to the poore people of the parishe of Washington aforesaid Five pounds to be payd to them within one yeere next after my Decease Item whereas the Wardshipp of Edmund Muschamp my grandchild is Comitted unto mee by the right hon’ble the Mr of the Courte of Wardes both of his body Lande & mariage I leave the sume to my said Executor And my Will is that for my said Nephewes education at Oxford duringe his minoritie hee shalbe allowed such mayntenance as shalbe fittinge his degree & quality And whatsoever shalbe remayninge out of the rents of the [...] and expences of himself & his two sisters for their educacon being Deducted I will shalbe assigned & reserved towardes the raysing of porcons to be Devided into three equall partes. One parte to be payd to him the said Edmond and the other two parts to his two Sisters at their severall ages of one & Twenty yeares And my will is tht the marriage porcon which shalbe given with a wife for my said Grandchild Edmund Muschamps marriage (which I will to be tendred him before hee accomplish the age of one & Twenty yeares shalbe alsoe devided into three equall partes & be payd as aforesaid to those my Three Grandchildren at their severall ages of one & twenty yeares And I doe humble desire the right hon’ble the Mr of the Courte of Warde to order this accordinge to my Will Provided allways that whatsoever wife shalbe tendered to my said Grandson Edmond Muschamp shalbe by the approbation & Consent of my Worthie frendes Sir Edmond Bowyer of Camerwell knight Lawrence Pay Doctor in Divinity Archdeacon of Chichester & John Chadwell gent Attorney at lawe or two of them Item I give & bequeath to the use of my Daughter Elizabeth Byne Duringe her naturall life the sume of Five hundred pounds And after her decease I will & bequeath the said Five hundred pounds to my Grandchild Mary Muschamp And my will & meaninge is That my said Executor shall have & deteyne the said Five hundred pounds duringe the naturall life of my said Daughter Elizabeth provided that he give security unto the said Doctor Pay & to his brother John Pay gent for payment of Thirtie six pounds per Ann. quarterly for the use of my said Daughter unto whomsover shalbe trusted with her educacon by this my Will And for the payment of the said five hundred pounds to my Grandchild Mary Muschamp after my sayd Daughters decease And my will & meaninge is that my wife the Lady Byne shall have the educacon of my said Daughter & Grandchild duringe her my said wyves life And after her decease I desire the said Doctor Pay to take care for them & their educacon if he be lyvinge And after his decease his brother John Pay is hee be liveing And after his decease Then my younger sonne John Byne Item I give & bequeath unto the said Marie Muschamp fower hundred poundes to be payd unto my sayd wife or to whomsoever shall have the educacon of her the said Mary to be payd within Twelve monthes next after my decease And for her education in the meanetyme I will that my Executor shall pay Tenn pounds to my wife or to whomsoever shall have her educacon according to this my will which fower hundred pounds I will shalbe payd to the said Marie at her age of one & twentie yeares or Day of marriage which shall first happen Item I give & bequeath unto my loveing wife the Lady Byne all her weareing Apparell Jewells Rings Borders & peeces of silke stuffe in her keeping six silver spoones and Two silver porrengers daily used in her Chamber A silver Basin & Ewer A silver Trencher Salte & halfe my houshold lynnen of every sorte One featherbed a Rugg two blanketts bolster & pillowes with the Bedsted & furniture belonging to the same in the Chamber where wee now lye And twoe other fetherbeds for servants with all the furniture thereto belonginge, such as the Overseers of this my will shall think fill Item I give & bequeath unto my sonne John Byne my seale gold Rings which I weare & the Lease of a Barne in the parish of Lynnffield in Surry. Item I give & bequeath unto my sonne Johns wife a gold Chayne which was my mothers Item I give & bequeath unto every one of my sonne Johns Children Five poundes a peece to be payd to them at their severall ages of fowerteene years Item I give & beqeath unto my servants Robert Baker five pounds To Thomas Sary five pounds To Elizabeth Tilly Three pounds To John Denett Fiftie shillings To Thomas Gent Thirty shillings To be payd to them severally within Two yeeres next after my Decease Item I give & bequeath unto every other of my Houshold servants whoe shalbe Dwellinge with mee at the tyme of my Decease Twenty shillinges a peece to be payd to them within twoe yeares next after my Decease All the residue of my goods Chattells Leases Debts owinge unto mee & my Debtes & Legacies & funerall expences being Discharged I give & bequeath unto my sonn Edmund my Executor before named. And I Doe nominate & appointe my worthy frends the said Dr Pay Archdeacon of Chichester Henry Goringe Esq. Henry Bridger gent & William S[?] yeoman to be Overseers of this my last will And for raisinge of monyes to pay all the Legacyes by mee bequeathed I doe hereby give to them & every of them full power and authoritie to sell soe much Tymber & woods groweinge standinge & being upon Byne Farme as shall Discharge the same unless my Executor be otherwise inabled to performe & paye the same out of my personall estate or by such other meanes & security as shalbe approved & allowed by my said Overseers or twoe of them whereof I will the said Doctor Pay shalbe one And whatsoever necessarie expences my said Overseers shall be at in [?] and performance of any trust Comitted by mee unto them I will shalbe borne & allowed to them by my Executor And my will & meaning is That if any question or Controversie shall arise touchinge any thing Conteyned in this my last Will & Testament it shalbe ended decided & determined by my said Overseers or twoe of them at least whereof I will the said Dr Pay shalbe one Item I give moreover unto my said wife the Lady Byne a Warming Cup of silver with a Cover and one Trunke & one Chest which shee shall choose. Item I give and bequeath unto Elizabeth Muschamp my Grandchild One hundred poundes to be payd to her at her age of One & Twenty years or Day of marriage which shall first happen And I give to my said wife the Lady Byne a Deske which shee useth and a little Cabinett of mother of pearle and the use of any Houshold stuffe the said Dr Pay shall thinke fitt for a yeer & after to be restored to my Executor In testimony whereof I have here put my hand & seale the Day & yeare first above written And declared this to be my last will & Testament And the alteration of six blotted & Cancelled & five interlyned And the other interlyninge newe done before the sealeing subscribeing & publishinge of the same.
