Will of James Tosh

IN THE NAME OF GOD AMEN! the third day of July in the year 1750, I James Tosh of the township of Drumore and County of Lancaster plantioner, (sic) being very sick and weak in body but of perfect mind and memory thanks be given unto God therefore calling to mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament, that is to say principally and first of all I give and recommend my soul into the hands of Almighty God that gave it, and my body I recommend to the earth to be buried in decent christian manner, at the discretion of my executors nothing doubting but at the general resurrection I shall receive the Same again by the mighty power of God, and as touching such worldly estate wherewith it hath pleased God to bless me in this life I give demise and dispose of the same in the following manner and form.
Imprimis, I give and bequeath unto my well beloved wife Caetrin and two children, all my real and moveable estate, my just debts paid of the whole the first ye remendar (sic) shall be equally divided into three shares, one third to my wife, one third to my daughter Elizabeth and the other third to my young child not yet born.
Item I make and ordain Moses Irwin and Catren (sic) my well beloved wife my whole and Sole Executors of this my Last will and testament, I also order that if any of my two children die before they come to age the other child shall have the deceased childs share.
I do confirm this and no other to be my Last will and testamet. In witness whereof I have hereunto set my hand and Seal the day and year above written.

SIGNED sealed and published, pronounced & declared by the said James Tosh as his last will and testament in the presence of us the Subscribers, David Montgomery, Jonatha Gay, John Mitchel.
Personally appeared before me this thirty first day of July 1750 David Montgomery and Jonathan Gay two of the witnesses to the within will and upon their Solemon oaths, did depose and declare that they were present and saw and heard James Tosh the testator Sign, Seal publish and declare the within writing for and as his last will and testament, and that at the doing thereof he was of sound mind and memory to the best of their knowledge and belief.
