[HI32877] (Research): Champaign County, OH, Record Book 8, Page 467 - Filed 4 June 1824 - Petition for Dower Jane Hornback, widow of John Hornback Vs James Hornback, John Hornback, Abraham Hornback and Simeon Hornback. John Hornback died in February 1824 seized of the west half of Section 8 Township 4 Range 13 (Harrison Tp.), however, the patent was in the name of the son, James Hornback. John left all of his estate to his children, except a trifle which was left to his wife. John and Jane were married about 13 years ago (1811) in Pickaway County. Both had children by former mates, but no children were born to John and Jane. Jane had $500 which went to John on their marriage and John used this money to purchase the land. He paid the first payment and got a certificate, the second payment he paid through John Wall, the third payment through John Vaughn and the fourth through his son, James Hornback. George Hornback, a remaining son, was given $400. The defendants say that the father was married to Jane, but not legally as her husband, James Campbell, was still living when they were married and that Jane began living with John Hornback in Kentucky when James left. They claim that John purchased the land but sold it to James at least two years before he died. The court decreed that Jane was entitled to the dower plus the value of $53 which was rents due since the death of John Hornback.
