4 June 1829
Jacob Nicely of __ in the County of Highland in the State of Ohio has applied to the Secretary of the Treasury for the benefits of the act, entitled "An act for the relief of certain surviving officers and soldiers of the Revolution," approved the 15th of May, 1828. He states that he enlisted in the Continental line of the Army of the Revolution, for and during the war, and continued until its termination, at which period he was a Sergeant in Captain J Clark's Company, in the 8th regiment of the Virginia line; and that he received a certificate for the reward of eighty dollars, provided by the resolve of the 15th of May, 1778; and further, that he was not on the 15th of May, 1828, on the pension list of the United States, and that he has received as a pensioner since the 3rd of March, 1826, nothing
The Third Auditor is requested to report how far the several statements are corroborated by the records in his Office.

It appears by the records of this office, that a certificate for the reward of eighty dollars has been issued to __ in the ___
It further appears that Jacob Nicely is not now on the pension list of any agency, and has not been so since the 3rd March 1826 at the rate of __ dollars per month.
The name of Jacob Nicely cannot be found among those of the Virginia line to whom Certificates for the gratuity of $80 were issued.

For the purpose of obtaining the benefits of an act entitled "An act for the relief of certain surviving officers and Soldiers of the Army of the Revolution" approved on the 15th May 1828 I Jacob Nicely of Brus-Creek [sic, Brushcreek] Township in the County of Highland and State of Ohio do hereby declare that I enlisted in the Continental line of the Army of the Revolution for and during the war and continued in the service until its termination, at which period I was a Sergeant in Captain Jonathan Clarke's company in the 8th Regiment of the Virginia line. And I further declare that I have never been on the pension list of the United States.

The State of Ohio, Fayette County SS –
Before me S. Demsey a Justice of the peace in and for said County, Jacob Parret Senior, who being legally sworn by me, the said Parret, on his oath, deposeth and saith, that he the said Parret is and has been personally acquainted with Jacob Nicely who made & the foregoing declaration, ever since the said Nicely entered the Army of the United States in the year A.D.
1776 on the 22nd of March, in Captain Jonathan Clark's Company of the 8th Regiment of the Virginia line on Continental service – The said Parret further saith, that he, this deponent, belonged to the said company, and well recollects the said Nicely's serving in said company Regiment &c. And having had frequent interviews with the said Nicely since the disbanding of the Army, this deponent is sure as to the identity of the said Nicely – This deponent states further, that the said Nicely was in the aforesaid service at the time the Army was disbanded at the close of the War, and this deponent verily believes said Nicely never was out of said service during the War.
