Will of Francis Cullom

Last Will and Testament
In the name of God Amen I Francis Cullom of Clark County and State of Kentucky being of Sound mind and memory and bring to mind the mortality of this Body and though certainty of Death when it shall please God to call me hence do make constitute ordain and Deliver this my Last will and testament in the manner and form following Revoking and disallowing all and Every Testament or Testaments Will or Wills heretofore by me made And this to be taken only for my last Will and Testament and none other and now for the Settling of my estate and Such goods and chattels as it hath pleased God to bless me with.
I do Ordain give and dispose the same in the following manner that is to say first I will that all my First debts that I now owe be paid Secondly I give to my well Beloved wife Susannah one hundred and sixteen acres of Land lying wereon I now Live and to join the line of John Haggard and myself and the line of my son Frances Cullom so as to include my dwelling house and other necessary buildings convenient to the same I also give to my said wife all my household and Kitchen furniture of every Description the whole of my farming utencils on black mare and on Sorrel mare and also two first choice cows freely to dispose of as she may chuse and at her death to bequeath to whom she may think proper.
Thirdly my will is that my Negroes be set free at the time and age here after mentioned (to wit) my Negroe woman Abigail to be free from and after the first day of January next my negroe man Jack to be set free on the 10th day of March One thousand Eight hundred and twelve my negroe man Joe to be free five year's after the date of this my Will my negroe woman Jenny to be set free seven years after the date of this my will my my negroe fellow Sam to be set free ten years after the date of this my Will and also my negroe boy Charles to be set free fifteen years after the date of this my will the whole of the afore named Negroes to serve until the time afore mentioned and to be at the Controwle and desposil of my beloved wife aforesd or my Legal Executor hereafter mentioned and in case my negroe woman Jenny afore mentioned should have any Childron if they should be boys to be set free at twenty one years of age and if gerl childron or child to be set free at sixteen years of age.
I also will to my beloved wife aforsd one half of all my hoggs.
Fourthly I will to my son William Cullom one Sorrel horse three years old this spring to receive when he shall think proper and fifthly my will is the whole and balance of my land and goods and chattels not Other wise provided to be sold by my Executors hereafter named and the money Equally divided between my Childron that is now living Excepting my son Francis Cullom he is to have One hundred Dollars out of the Sails money before the division ____ his place and then he have an Equal Share afterwards with the rest and also my will is that the proportionable part that should fall to my daughter Fanney McDermid as a Childes part of my estate as is before mentioned shall be hers the sd Fanneys during her natural liftime and at her death to her the sd Fanneys legal issue my will also is that my Executors hereafter named shalt not pay to my said Daughter Fanney heirs proporrtionable part of said Sail money nor to no other person without taking bond and Security that is Sufficient for the amount to Deliver and pay the same to my aforsd Fanney McDermid legal heirs when they may become of age and to prevent scrutiny or disputes who is my Childron they are named as follows (to wit) William Cullom, Mary Owen, Abigal Owen, Susannah Browning, Fanney McDermid, Edward N. Cullom and Francis Cullum and Lastly I Constitue and appoint my beloved wife Susannah and my Son Francis Cullom Executors of this my Last will and testament as witness my hand and sent this 10th day of March 1810.

This Last Will and testament of Francis Cullom Deceased was proven according to Law by the Oaths of Nicholas Aldridge and John B. Ryan witnesses the veto subscribed and ___________ to be recorded and on the motion of Francis Cullom one of the Executors therein named who made oath there to as the Saw directs Certificate is granted him for obtaining a probate thereof in due form giving security whereupon he together with Edward Kindred, William White and John Vivion Senr. entered into and acknowledged their bond in the penalty of $10,000 Conditioned etc _____- to law for the due and faithfull administration of the said deceased Estate and performance of his will Liberty being reserved for the other Executor therein named to join in the probate when she shall think fit.
