Will of Eliza Chinn Carter, "widow of Joseph A. Carter", dated 26 JUN 1841, presented in Superior Court of Law and Chancery 29 MAR 1844, appealed in suit of Marietta E Carter vs. Addison L Carter and others, appeal withdrawn by consent of the parties with the note "See will filed with November Court papers." It is recorded in Will Book 29, p. 48.

The will leaves to her three youngest children and their children her entire estate provided they will "never sell my house and land where their dear father's bones now repose" and "trusting in the Lord to appoint them a Christian guardian that will attend to their education" and "my other children being better provided for cannot expect one cent." Her land called Nuttsville "shall never be sold but owned by one of my heirs and that my children be raised in my own house--hoping Lumbard [son Addison L] Carter will do all he can to promote their welfare, remembering I did all that was in power for him. I leave him [Addison L Carter] my only son my executor, but to give security praying to Almighty God to take care of them I bed them farewell."

The three youngest children were Welelmina, Adalina and Althea Carter.
