It was proven in Court this day by the oath of Charles M Brown of this County that Charles Brown, late a pensioner of the United States, departed this life on the 8th day of October 1833 and that the said Charles Brown was the identical person named in an original certificate now here shown to the Court bearing date 5th June 1830 and signed by John H Eaton, Secretary of War, granting to the said Charles Brown a pension of $8.00 per month and numbered 20158. And it was further proven to the Court that Tabitha Brown is the widow os said Charles Brown, deceased, and that she is now living. January 13, 1834. [pg 136]

    State of Kentucky
    County of Hopkins Ss.
    On this 11 day of May 1829 personally appeared in open th Court being a Court of Record so
    constituted by Law for the County of Hopkins in the State aforesaid Charles Brown resident in said
    county aged Seventy Six years who being first duly sworn according to Law doth on his oath make the
    following Declaration, in order to obtain the provisions of the Acts of Congress of the 18th March 1818
    and the 1st May 1820 that he the said Charles Brown enlisted, for the term of Two Years in the latter part
    of the year 1775 or first part of the year 1776 not distinctly recollected in the State of Virginia in the
    company commanded by Captain Joseph Spencer in the 7th Regiment commanded by Colonel Woodford
    in the Line of the State of Virginia on Continental establishment. that he continued to serve in the said
    Corps Two Years when he was discharged at the White Marsh [Whitemarsh] Camp in the State of
    Pennsylvania but does not recollect the date. that his discharge was washed up in his clothes without his
    knowledge or any design on his part. that he hereby relinquishes any claim to a Pension except the
    present, that his name is not on the Roll of any State except Virginia, and that the following are the
    reasons for not making earlier application for a Pension: Viz
    That until April in the year of 1827 he was able to labour for and procure a support and that he
    did then make application for a Pension, which was rejected. That his disability to labour arises from old
    age, and paralysis of the Right Side and Arm Charles hisXmark Brown
    And in pursuance of the act of the 1st May 1820 I do solemnly swear that I was a resident Citizen
    of the United States on the 18th day of March 1818 and that I have not since that time by gift sale or in any
    manner disposed of my property or any part thereof with intent thereby so to diminish it as to bring
    myself within the provisions of an act of Congress entitled “an act to provide for certain person engaged
    in the land and naval service of the United States in the Revolutionary War” passed on the 18th day of
    March 1818 and that I have not nor has any person in trust for me any property or securities contracts or
    debts due to me nor have I any income other than what is contained in the Schedule hereto annexed and
    by me subscribed, and marked & referred to as No. 1. That since the 18th of March 1818 the following
    changes have been made in my property See Schedule Marked F & Document marked H. a part of the
    proceeds arising from the sale thereof he paid his debts with; and a part he gave to his children and
    applied the balance to the support of himself and wife who now comprise his family. He states that it is
    utterly impossible to shew by vouchers from his creditors, and Receipts from his children, in what
    manner, and to what objects the portion of the proceeds of the sale aforesaid were applied, the said
    present being dispersed over the State and far beyond his reach by reason of his infirmity and poverty.
    That he is by occupation a farmer, but is unable because of his decrepitude to pursue it that his wife is
    unable to do any thing of consequence by reason of an injury to both arms by a fall from a horse

    Given under my hand this 9th day of April 1827.
    [The file includes an “Inventory of Charles Browns sale this 5th of Dec 1818” listing some of the items in
    the schedule above, which sold for a total of $147.69. The file also includes another “Schedule No 1" dated
    11 May 1829 with a value of $147.87.]
    State of Kentucky Madison County Sct.
    Galen White [pension application S31476] and George Tomlinson [Ambrose (or George)
    Tomlinson, S31429] this day personally appeared before me, a justice of the peace for the county
    aforesaid, and made oath that they well recollect that Charles Brown enlisted in the sevice of the United
    States in the year 1776, under Captain Joseph Spencer, for two years, in Col. Woodford’s regiment (which
    was the 7 Virginia line) and that they frequently saw him in public service th during the war Garlin
    Burnley [sic: Garland Burnley] was his Lieutenant and William White his Ensign. Given under my hand
    this 29th day of May, 1826.
    Kentucky Fayette county Sct.
    Richard M Price personally appeared before me a justice of the peace for said county and made
    oath that he was orderly sergeant [see endnote] in Capt. Joseph Spencers company of the 7th Virginia
    Redjiment on Continental Establishment in the Revolutionary war, and recognises the person present to
    be Charles Brown, who served for two years in said Capt Spencer’s company and was a messmate with
    himself during said time in the said Revolutionary War. The years 1776 and 1777 were the said time of
    said Brown’s service. June 5th 1826. Richard M. hisXmark Price
    NOTES:
    Brown’s claim was apparently rejected because he had too much property. On 19 Nov 1829 he
    successfully petitioned the US Congress for a pension.
    The duty of an orderly sergeant was to copy each day’s orders into the company’s orderly book.
    It would therefore be expected that Price would have signed his name in full if physically able.
