From Ward's Genealogical History of the Rice Family, p. 10: May 23, 1685, Benjamin Rice, of Sudbury, sued Dr. William Avery, of Boston, for malpractice. Verdict for defendant. In that suit, Daniel Pond testified that, "ten years ago, Benjamin Rice, of Sudbury, came to my house, in Dedham, with his feet frozen and lodged there. Dr. William Avery's son, Benjamin, cut off one foot at the lowest joint, and stanched the blood with a musquash skin." Dr. William Avery does not appear, by the evidence in the case, to have been present at the operation. The malpractice, if any, was therefore not chargeable to him, but to his son, Benjamin, hence the verdict. References
