Will of William Daugherty

Will of William's Daugherty, dated November 10, 1835.
In the name of God, Amen:
I, William Daugherty of the County of Lee in the state of Virginia, being weak in body, but of sound mind and dispoiing memory, do make and ordain this my last will and testament as follows, to-wit:
FIRST. I desire that all my just debts and funeral expenses be paid out of my estate by my Executor herein after appointed.
SECONDLY. I give to my beloved wife, Elizabeth Daugherty, during her lifetime the following property, Viz, the plantation whereon I now live with all the household and kitchen furniture, and one negro man named Joe, one negro woman named Dicy, and one negro girl named Mary, one yoke of oxen and cart and work horse and one negro man known by the name of the Lame Man and all the cattle and hogs and on half the sheep which I now have or may have at my decease.
Thirdly. I give to my son , Charles Daugherty, Executor of this my last will and testament, revoking all other or former wills heretofore made by me. In testamony whereof I have herunto set my hand and affixed my seal in the presence of the subscribing witnesses hereto on the tenth day of November in the year of our Lord one thousand and eight hundred and thirty five.

At a court begun and held for Lee County, at the courthouse thereof on the 18th day of January, 1836. This last will and testament of William Daugherty deceased, was proved by the oaths of John Hamblin, Alexander W. Mills and William Hamblin witnesses thereto and ordered to be recorded.
Pursuant to an order of the worshipful court of Lee County, entered on the 19th day of January 1836, appoint the undersigned, appraizer of the personal estate of William Daugherty deceased, we, after being duly sworn before a justice of the peace, make the following schedule:

Information on William Daugherty

2. William was from Guilford County, North Carolina, but served as a substitute for a certain John Iron, who was a spy in the militia of Washington County in Powell's Valley in 1792/93. William came to Lee County, Virginia in the 1700's. On April 16, 1789, he sold to John Lewis of Lee County, 85 acres for 30 pounds, which had been granted to William by patent. It was described as lying on Powell River on both sides of Pancake Creek, the waters of Trading Creek, Poor Valley Ridge. Lee County was formed from Russell County in 1792.

3. William also acquired 428 acres and continued to buy and sell. At the time of his death at age 73, he had acquired a considerable estate. On May 19, 1800, he bought 400 acres from Edmund Smith of Garrod County, Kentucky. He paid 200 pounds for the property which was situated on the headwaters of Cane Creek on the Sugar Run in Lee County, Virginia. On June 9, 1800, he sold 118 of those acres to Daniel Russell. On may 29, 1810, he was taxed on 2 white tithables and 5 horses. On March 29, 1829, William sold 200 acres on Poor Valley Ridge to Charles Daugherty (believed to be William's son?)for $600. The 1830 Census lists William as being 60-70 and Elizabeth as 60-70. (Note: Refer to Deed Book 2, Page 52 to confirm the location of the place where William Daugherty and other of the family are buried. Recorded May 29, 1807).
