    Transcribed by Will Graves 9/16/11

    State of Kentucky Mercer County:
On this 14th day of March 1833 personally appeared before me a Justice of the peace in Judge of the Mercer County court Tobias Wilhite a resident Citizen of said County aged 83 years whose infirmities make it inconvenient and difficult for him to attend in open Court who having first solemnly affirmed according to law (he being of the denomination of people called believers or Shakers) doth make the following declaration in order to obtain the benefit of the act of Congress passed the 7th day of June 1832 viz. I Tobias Wilhite do solemnly affirm in answer to the several interrogatories put to me by direction of the War Department, That I was born in the County of Culpeper in the State of Virginia where I lived when I was called into the service of my country in the revolutionary war as follows viz. on the 8th day of August 1777 I was drafted & marched in Captain Ephraim Rucker's company from Culpeper courthouse my Regiment was commanded by Colonel Barbour and the Major was Roberts in my company was attached to General Stephens' [Edward Stevens'] Brigade, and we marched to Germantown where we arrived after the battle at that place and soon after my time expired which was three months tour but four months before I reached home I was honorably discharged.
Again in the month of June 1780 I was drafted for three months in Captain Ephraim Rucker's company and Colonel Barbour's Regiment but having been taken sick I did not serve my whole time with my company having only been able to serve three or four weeks but was prevented by sickness having performed my duty as far as I was able again in the month of July 1781 I was drafted in Captain Ephraim Rucker's company and Colonel Barbour's Regiment and in General Stevens' Brigade and performed my duty until my time expired which was about one week before Lord Cornwallis was taken at Little York where I aided in enclosing him before the surrender, and I was discharged at Little York. I was not in any battle – I was drafted the several times I was in the war which amounted in the whole to the time I have stated which was nine months in all including the time I was sick I further state that I have no record of my age only as I have been told by my Parents. I received discharges from each tour but I have long since lost them and I never held any commission during the revolutionary war. I lived in Culpeper County Virginia during the war, when not in actual service in about the year 1799, I removed to Kentucky and that the last twenty-four years I have lived in the County of Mercer. I do not know of any person now alive except Polly Wilhite and Abraham Wilhite whose affidavits are annexed by whom I can prove my service. I do also hereby relinquish all claim which I have to any pension or annuity except the present, and I am not now neither have I been at any time on the pension roll of the United States or of any State. Witness my hand this 14th day of March 1833.
