From Mary Richardson, Personal communication to Q 22:03, 18 July 2014 (UTC)A strong case can be made that Rebecca HAYS' first husband was Thomas MAXWELL, a son of immigrant ancestor John, Maxwell's Gap in Tazewell Co., VA, is named for the place where he was killed by Indians whilst trying to save the family of Thomas INGLES. The Harmon HAYES WeRelate page mentions that Rebecca and Thomas had four children. First I've heard of a fourth child. Only one is named on this page: Sarah "Sally," wife of Newett DREW, matches my records. The names of the other children remain in dispute. For instance, some say there was a son named Sidney, but there is reason to believe his DNA doesn't match my family's.

I have heard that Thomas and Rebecca had two daughters, Sarah and Mary Maxwell, though I’ve never seen any proof of Mary’s existence. In the following message board post a claim is made that the posthumous grant of land in Tazewell Co., Virginia was given to both Sarah and Mary. I wonder if there is a grant that names both daughters?

Capt. Thomas Maxwell was killed by Indians in 1782 on Tug Mountain, trying to help Thomas Ingles recover his family captured by a tribe Ingles had been reared with. After Thomas died, his daughters, Mary and Sarah, were awarded acreage in Montgomery Co. VA/Tazewell Co.VA, on the North Fork of the Clinch River, adjoining Mr. Taylor and James Maxwell, Thomas' brother. Thomas Maxwell's widow, Rebecca, married John Hays, and the family moved to Wilson Co. TN. What happened to Mary? Did she marry? Did she die young? When Sarah married Newitt Drew in TN, John and Rebecca Hays turned over the land awarded to Mary and Sarah to Drew. It was then sold to James Maxwell, I think. Audley Maxwell signed the transaction. Mary was not mentioned in her mother's will, so I'm afraid she didn't survive.

Re: SW VA Harmon/Harman-Maxwell Connections In an interesting incident that occurred in 1774, Thomas Maxwell and Israel Harman (son of Jacob Jr., named after his grandfather, Israel Lorton) were the designated scouts of Captain/Major Daniel Smith, and they got into a lot of trouble when they moved the Jacob Harman family back to the New River area to get them out of the danger of Indians, instead of doing the scouting mission they were assigned.
