Last Will and Testament of SAMUEL JACKSON Deceased

I SAMUEL JACKSON of Marion County VA calling to mind the uncertainty of life and being now well stricken in years and declining in bodily health & strength, but of sound mind, and disposing memory do hereby make and publish this my last will and testament hereby revoking any and all wills or codicils to wills by me at any time heretofore made.

1st I will and bequeath to my beloved wife NANCY JACKSON all the household goods effects & person property which I now possess to be by her kept and used during her natural life and at her decease the same as it shall then be & remain to be sold by my executor herein-after named and the proceeds of the sale thereof to be equally divided amongst the four children of my deceased daughter LAVINNA DAWSON or amongst such of them as shall be living at the decease of my said wife (said children being CHARLES T., WM. B., VIRGINIA & EMMA M. DAWSON)

2nd My sons MARSHALL, OLIVER & JAMES R. JACKSON have been provided for & received their portions of my estate.

3rd To EDITH MAY Daughter of my Daughter MARTHA A. JACKSON I the lot of about five acres of land which I purchases of A. F. RICHIE Esq and especially authorize & empower the guardian of said

EDITH MAY upon due qualifaction & executing bonds with goods security to sell said parcel of land & convey the same if & whenever the best interests of said EDITH MAY in the premises may seem to require it and to safely invest the proceeds of such sale or lone it well secured for the use & benefit of said EDITH MAY.

4th The Dwelling house & two lots (No. 5 & 6) in Fairmont which I now ocupy I will shall be used ocupied and enjoyed by my said wife NANCY until a Judicious sale thereof can be made and that the same be then sold & conveyed by the executor of this will on favorable terms as to credit (such sale to be at public or private sale as may be best) and out of the nett proceeds said executor shall first pay a ballance of some forty dollars due yet on the said five acres parcel of land hereinbefore devised to said EDITH MAY - and that the residue of the proceeds of sale to be loaned out on goods real estate security on interest to be paid semi annually and that said interest together with the interest that accrues on the said funds from the day of sale till loaned as aforesaid (which interest shall also be paid semi annually or annually) be paid to my said wife NANCY during her natural life and the said funds shall then be equally devided between my three daughters RUHAMA

BOYDSTON, LU*ETTA FLEMING & MARTHA A. JACKSON or said daughters devisees as aforesaid May receive each their portion of said funds so soon as the sale of the property & collection of proceeds shall be made on condition that they each execute bonds with good substantial security binding them each to pay my said wife NANCY the interest on their respective shares in Manner & form as aforesaid and I hereby Nominate & appoint my son OLIVER JACKSON executor of this my last will & testament and in the event of his decease or removal or resignation I desire & appoint my son JAMES R. JACKSON to execute the same in any part not executed by said OLIVER. My debts are all paid except the $40 above provided for My funeral expenses & the costs of administration if not otherwise provided for shall be paid out of the proceeds of the sale of said dwelling house lots & premises before distribution.
