In the book, "Memorial History of the Powell Family and others - 1880" by Rev. John Powell, the following information on page 376 appears: "On the 11th of October 1838, a large concourse of ministers, friends and neighbors convened at the late residence of Bishop (Samuel) Hiestand. Rev. Jacob Winter preached in German and Jaocb Miller in English after which the Bishop was buried according to his previous request, beside his pious mother (Maria Elizabeth Brumbaugh Heistand), in the Heistand Burying Ground, in the northeast corner of his farm in Liberty township, Fairfield County., Ohio"

Note: Ken and I have found a marker for him in the Bethel Cemetery located in Greenville township a mile away on the corner of Stringtown Rd and County Rd 17. --Msscarlet1957 22:21, 18 July 2008 (EDT)

Samuel's Will:

"In the name of the Lord amen! I Samuel Hiestand of the county of Fairfield and the state of Ohio, being now in ill health of body, but of sound and disposing mind, memory and understanding, blessed be almighty God for his mercy and goodness towards me in this and all other particulars considering the certainty of the death and the uncertainty of time thereof, and being desirous to settle my worldly affairs and to make a proper disposition of the estate both real and personal which by the goodwill and pleasure of the Lord hath been acquired by me do therefore now make ordain and publish this my last will and testament in manner and form following that is to say:

  • FIRST I commend my soul to the maker of heaven and earth and my body to the dust out of which it was formed to be buried in a decent and Christian manner.
  • SECOND I order might just debts and funeral expenses to be paid out of my estate as soon after my decease as may be
  • THIRD it is my will and I do order that my beloved wife Margret shall have hold the possession of all my real estate until my youngest child shall arrive at the age of 21 years, provided she shall remain my widow but in case she shall marry again then she shall only take dower in the same according to law.
  • FOURTH it is my will and I do order that my executors hereinafter named shall (illegible looks like "execute") all of my personal estate to be duly upraised according to law, and to sell only so much thereof as shall be sufficient to pay my just debts, funeral expenses, and costs necessary and defraying the expenses of settling up my estate in a legal manner and the residue of any I hereby order to be pay to my said wife if she be living and unmarried.
  • FIFTH it is my will and I do order that in case of the death or marriage of my said wife, that my whole estate both real and personal shall be sold (subject to the dower of my wife if she be then married) by my executors herein after named either at public or private sale as shall appear to them most profitable and advantageous, and the proceeds thereof to be divided among all the legal heirs of my body - that is my children or their representatives. my wife if alive and married to have such portion of my personal estate as she shall be entitled to by law. and my executors are hereby invested with full power and authority to execute and deliver all necessary conveyances for real estate sold under the provisions of my will.
  • SIXTH for as much as my son Tobias has rendered need valuable service said he has attained his age of majority, I hereby order that he shall receive this sum of $120 more than and equal dividend of my estate.
  • SEVENTH the I do hereby granted on to my wife full power so long as she shall have the position and control of my real estate to rent the same and to prosecute with effect all suits for the collection of said rents, or for waste trespasses or other wrongs committed to the -- of the same. and in case of her death or marriage and until the same shall be sold by my executors (which I direct shall be done with as little delay as practical, the same power and authority is given to my executors hereinafter named.
  • EIGHTH the rents and profits from my real estate are intended to defray the necessary expenses in rearing my minor children and of educating them in a proper manner and I hereby direct my wife to see that the same be proper and done during this time she may be in the receipt of the farm, and in case of her death or marriage the same is strictly enjoined on my executors.
  • and I Lastley and hereby constitute and appoint my beloved sons, Emmanuel and Tobias, or the survivors of them to execute this my last will and testament. hereby revoking and annulling all former and other wills by me made and ratifying this and none other to be my true last will and testament."
