Anderson County, Lawrenceburg, Kentucky, Will Book A PAGE 92-97 In the name of God, Amen. I, Samuel Butts, of Anderson County and state of Kentucky, being more diseased in body, but of sound mind and disposing memory and knowing it appointed by Almighty God, that man must die, and feeling that I am approaching to that solemn event, do in order to meet it dispose of my earthly estate with which God has blessed me in the following manner viz. Item 1 __ I will after my death, that my body be intered in decent Christian Burial. Item 2 _ I will that all my honest debts be paid. Item 3 _ I will and bequeath unto my beloved my wife Nancy Butts, during her life, the plantation on which I now reside, containing about 200 acres more or less, together with my Negro woman, Caroline, and all her children and my Negro man, Will or William, together with so much of stock, farming utensils, household and kitchen furniture, as she may stand in need of and after her death, I wish my executors, herein after named, to divide out all the reside of my estate equally among all my children except the Heirs of my son Samuel Butts, to whom I will and bequeath nothing more than I have heretofore advanced to them. Further, the amount of which is charged to him in my memorandum book here produced, as an exhibit marked A and which is here inclosed and part of this will. Item 4 __ I wish my executors after my death, to hire out my Negro man, Lake, during the life of my wife aforesaid and apply the proceeds to the payments of my debts and when they are paid, to put the said proceeds to interest until the death of my said wife. Item 5 __ I appoint my son, James M. Butts, Larkin H. Penney and Nathaniel H. O'Dell or the survivor of them my executors to carry this will into effect. Hereby revoking all others heretofore that may have been made by me. In testimony whereof I have hereunto set my hand and seal this 9th day of December 1843. Butts One boy named Lac to be hired out until the McCain debt is settled or sold before the money due from Griffy's estate after my debts are settled. Let all the property be divided equally among the Heirs with the exception of Samuel M. Butts Heirs. They will be cut off with one dollar. And my wife is to have the plantation and Negro, Will and Caroline and other property as much as she wishes to keep. After the just debts are paid if money left, tis the money be equally divided. Likewise after her death let all my whole estate be equally divided among the Heirs, all except Samuel Butts Heirs. State of Kentucky Anderson County Seat I, Jordan Walker, Clerk of the County Court for the County aforesaid do certify that at a County Court held for the County of Anderson at the cour thouse in Lawrenceburg on Monday the 8th day of July, 1844 the foregoing writing purporting to be the last will and testament of Samuel Butts, dec. was produced in Court and proven by the oath of Jordan Walker and David Johnson, two of the subscribing witnesses thereto to be the act and deed of the same Samuel Butts, dec. Whereupon the same together with an account of a bill of _______ attached thereto was ordered to be recorded which together with this certificate hath been duly admitted to record in my office. Given under my hand this 18th day of July 1844. Jordon H. Walker, CLK State of Kentucky Anderson County Samuel Butts of said County and State makes oath, that he is the son of William Butts deceased, that his said Father in the month of September in the year 1779, entered into the Service of the state of Virginia, under & by the authority of said state as a private in Captain Mark Thomas Company in Majr George Slaughtors Corps against the Indians in the Western Country, now Kentucky, and that he continued in said service, until June 1780, and at Louisville in said month of June 1780, he was taken prisoner by the Indians - was taken off, and the affiant never heard of him more. He supposes his father died, or was killed by the Indians at some of their Towns North West of the Ohio River. Affiants Father at the time of his entering the service, from information was about forty or forty five years of age - Affiants father enlisted or engaged to service in said Corps for two year - The bounty promised him was Three hundred and twenty five acres of land, and a certificate for Forty eight Pounds on the Treasury of Virginia. Affiants mother the wife of his father received the Treasury Certificate - Said William Butts dec'd remained with the said Corps all the aforesaid time doing Service at all the points of defence from Culpeper County Virginia to the Falls of Ohio now in Kentucky, and performing service at Louisville until taken prisoner by the Indians - Affiant is the oldest son of said William Butts dec'd - There is also of his children living as he believes the following viz John, Rosanna, William, Elinor, & Thomas. Samuel Butts Sworn to and Subscribed by the above named Samuel Butts in the presence and before me a Justice of the Peace in and for said County this 21st day of February 1832. B.A. Car_____ J.P.
